Judgment :-

For the reasons stated in I.A. No.11876/206 for urgent hearing in winter vacation, the same is allowed.

Heard learned counsel for the parties on interim relief. By way of this petition, the petitioner is challenging the impugned action of the respondents in failing to provide clean and pure drinking water to the residents of Indore City, particularly in the area of Bhagirathpura.

It is argued that due to supply of contaminated drinking water, a large number of people are being infected and many people have died on account of said reason. He further submitted that Corporation as well as the State Government may be directed to supply clean water on regular basis and to provide best treatment to the affected persons immediately for saving their lives.

Counsel for the Municipal Corporation has submitted that 20 water tankers were supplied in the affected area on regular basis and in further they will ensure that there is no shortage of clean water in the affected area of Bhagirathpura.

Counsel for the State submits that regarding the treatment of affected persons, directions have already been given to the concerned hospitals and and doctors. All patients will receive proper treatment and expenses will be borne by the respondents/Government. He further submits that all affected persons will continue to receive better treatment in future as well.

By way of interim measure, the Municipal Corporation of Indore is directed to ensure supply of clean and pure drinking water to the residents of the affected areas and take all possible steps to supply clean water on regular basis. So far as treatment of the affected persons who are admitted in various hospitals is concerned, the State will take care of them and they would be given best treatment. Since the Municipal Corporation, Indore has already ensured that they will provide clean and pure drinking water in the affected areas and the State has already ensured to provide the best medical facilities to the affected persons who are admitted in various hospitals, the State and Corporation are directed to file a detailed status report on the next date of hearing in which they shall clearly mention that how many persons are affected and admitted in the hospitals and what medical facilities are being provided to them.

List the matter on 02.01.2026 along with W.P.No.50641/2025.
