2026 JHHC 860,
Summary :-
1. Statutes / Acts / Rules Mentioned:
- None

2. Catch Words:
- Promotion
- Writ Petition
- Interim Relief

3. Summary:
The petitioners filed writ petitions seeking promotion from Junior Engineer to Assistant Engineer. The first petition sought inclusion in the gradation list dated 18‑10‑2023, while the second sought promotion as their name was already on that list. During arguments, both parties acknowledged that the petitioners had already been promoted to Assistant Engineer under the General category. Consequently, the relief sought was already granted, rendering the petitions moot. The court vacated any interim relief previously granted and disposed of the petitions, directing any further grievances to be raised before the appropriate authority. Pending interlocutory applications in the first petition were also disposed of.

4. Conclusion:
Petition Dismissed
Judgment :-

1. Heard learned counsel representing the petitioners and learned counsel representing the respondents.

2. By filing these writ petitions, the petitioners have prayed for promotion to the post of Assistant Engineer from the post of Junior Engineer.

3. The main grievance of the petitioner in W.P.(S) No.6076 of 2023 is to include his name in the gradation list dated 18.10.2023 and promote him accordingly. The petitioner in W.P.(S) No.6396 of 2023 only seeks promotion as his name is already there in the gradation list dated 18.10.2023.

4. During the course of argument, learned counsel representing the petitioners and the respondents including the intervener admit that now the petitioners have already been promoted to the post of Assistant Engineer under the General category.

5. Since the petitioners have already been promoted as Assistant Engineer, the relief which the petitioners have sought for in these writ petitions, has already been granted to the petitioners. Thus, no purpose would be served to keep these writ petitions pending.

6. Accordingly, these writ petitions are disposed of.

7. The interim relief, if any, granted by this Court stands vacated.

8. If the petitioners have got any other grievance, they may raise it before the appropriate Authority.

9. Pending interlocutory applications being I.A. Nos.4569 of 2025, 12538 of 2025, 12552 of 2024 and 9272 of 2024, in W.P.(S) No.6076 of 2023, also stand disposed of.
