The petitioners filed a writ petition seeking a declaration that the respondent’s refusal to process their online applications for correction of pattadar pass books was illegal, arbitrary and unconstitutional. Judgment :-

1. This writ petition is filed by the petitioners seeking to declare the action of respondent No.3 in not considering their online applications bearing Nos.2600008925 dated 26.01.2026, 2600008902 dated 24.01.2026 and 2600008965 dated 26.01.2026 respectively for pattadar pass book correction in respect of the land admeasuring Acs.2-20 guntas in Survey No.338, situated at Bommarasipet Village, Shamirpet Mandal, Medchal-Malkajgiri District, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. M.S.Achyuth Bharathwaj, learned counsel for the petitioners; Ms. T.Swetcha, learned Assistant Government Pleader for Revenue, appearing for the respondents; and perused the material on record.

It is submitted that originally in 1975, about twenty one (21) pattedars got issued Occupancy Rights Certificates (ORCs) vide proceedings No.M/475/1975 dated 31.08.1976 by the then Assistant Collector, Hyderabad Eastern Division. That out of the said 21 pattedars, Mr. A.Doraiah was granted ORC in respect of the land admeasuring Acs.8-21 guntas in Survey No.327 and Acs.15-20 guntas in Survey No.340; Mr. Buchi Rangaiah was granted ORC in respect of the land admeasuring Acs.4-20 guntas in Survey No.337, Acs.2-26 guntas in Survey No.338 and Acs.4-06 guntas in Survey No.328; and Mr. Dugirala Parathasaradhi was granted ORC in respect of the land admeasuring Acs.2-37 guntas in Survey No.340, situated at Bommarasipet Village, Shamirpet Mandal, Medchal-Malkajgiri District.

4. Learned counsel for the petitioners submitted that the subject land admeasuring Acs.2-20 guntas in Survey No.338 is covered under the ORC granted to Mr. Buchi Rangaiah. Mr. Buchi Rangaiah executed a registered sale deed bearing document No.36 of 1981 dated 29.12.1980 in favour of Ms. U.Pramila and eight (8) others in respect of the land admeasuring Acs.2-20 guntas in Survey No.338 and Acs.4-20 guntas in Survey No.337. It is submitted that the subject land fell to the share of the vendors of the petitioners who executed sale deed bearing document No.3985 of 1985 dated 27.05.1985. Later, the petitioners entered into exchange with Ms. Challa Gayatri Devi vide registered exchange deed bearing document No.3137 of 2002 dated 22.06.2002 whereby the land admeasuring Acs.2-01½ guntas in Survey No.337 was transferred to the petitioners. Subsequently, manual pattadar pass books were issued to the petitioners under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 vide Patta Nos.916, 918 and 917 respectively.

Learned counsel for the petitioners submitted that after introduction of Land Records Updation Program (LRUP) by the Government, the subject land was found missing in the revenue records during the process of updation. Aggrieved thereby, the petitioners submitted online applications bearing Nos.2600008925 dated 26.01.2026, 2600008902 dated 24.01.2026 and 2600008965 dated 26.01.2026 respectively for pattadar pass book correction in respect of the subject land, however, the same has not been processed so far. As there is delay on the part of the respondent authorities in not considering their applications, the petitioners are constrained to approach this Court.

6. Learned Assistant Government Pleader for Revenue submitted that appropriate action will be taken on the applications of the petitioners in accordance with law.

Recording the aforesaid submission, without entering into the merits of the case, this writ petition is disposed of directing respondents No.2, 3 and 4, as the case may be, to consider the petitioners’ online applications bearing Nos.2600008925 dated 26.01.2026, 2600008902 dated 24.01.2026 and 2600008965 dated 26.01.2026 respectively for pattadar pass book correction in respect of the land admeasuring Acs.2-20 guntas in Survey No.338, situated at Bommarasipet Village, Shamirpet Mandal, Medchal-Malkajgiri District, by giving opportunity of hearing to the petitioners and to all other concerned/ interested persons, and pass appropriate orders in accordance with law, within a period of sixty (60) days from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition, stand closed.
