Judgment :-

(Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, to direct the respondents to dispose of the petitioner’s representation dated 31.12.2025 regarding to furnish the survey report of Survey No.84, Ward- A, Kadanagar Block.)

1. This writ petition has been filed seeking to direct the respondents to survey and demarcate the boundaries of the property more fully described in the prayer to this writ petition based on the petitioner’s representation dated 31.12.2025.

2. On the last hearing date, learned Special Government Pleader appearing for the respondents had placed on record the report of the respondents. According to the learned Special Government Pleader, as seen from the report, the respondents have completed the survey and demarcation of the boundaries.

3. Today, the learned counsel for the petitioner would submit that only a portion of the property was surveyed and the petitioner has also not been served with a copy of the survey report.

4. In reply, learned Special Government Pleader appearing for the respondents would submit that if the petitioner submits a fresh online application seeking for survey and demarcation of the boundaries, the entire property will be surveyed. The petitioner is more concerned with the property comprised in survey No.84, Ward- A, Kadanagar Block, as disclosed in the prayer to this writ petition for survey and demarcation.

No prejudice will be caused to the respondents if the petitioner is directed to submit a fresh online application with the respondents seeking for survey and demarcation of the entire property comprised in Survey No.84, Ward- A, Kadanagar Block, within a time frame to be fixed by this Court and a direction is also issued to the 3rd respondent to survey and demarcate the boundaries on receipt of the said online application within the stipulated time, after hearing the objections of the neighbouring land owners, if any and any other third party whom the 3rd respondent deems it fit to enquire, within a time frame to be fixed by this Court.

For the foregoing reasons, this Court directs the petitioner to submit a fresh online application seeking for survey and demarcation of the entire property comprised in Survey No.84, Ward- A, Kadanagar Block, within a period of one week from the date of receipt of a copy of this order. On receipt of the said online application within the stipulated time, the 3rd respondent shall survey and demarcate the boundaries of the subject property, after hearing the objection if any from the neighbouring land owners and any other third party, whom the 3rd respondent deems it fit to enquire, within a period of ten (10) weeks thereafter.

7. With the aforesaid directions, this writ petition is disposed of. No costs.
