(Prayer: Directing the 2nd respondent to forthwith issue the site Visit Certificate to the petitioner, based on the petitioners representations dated 27.12.2025 or in the alternative direct the respondents to permit the petitioner to participate in, upload documents for, and have his bid considered in the tender process relating to E- Tender Notice No.25/ VLR- CLE/ 2025- 2026 /dated 09.12.2025 (Tender ID 2025 _PWD_ 636405_1)without insisting on the site visit certificate.)

1. By consent of both the counsels, this Writ Petition is taken up for final disposal.

2. I heard Ms.P.Elakkiya for the petitioner and Mr.P.Gurunathan, Additional Government Pleader for the respondents.

3. The petitioner seeks a direction from this Court to the 2nd respondent to forthwith issue a site visit certificate so as to enable the petitioner to participate in the tenders called for by the 2nd respondent.

4. The petitioner is a registered Civil Contractor. The 1st respondent has initiated tenders for construction of Ware Houses for storage of EVMS and VVPATS in the District of Ranipet. The tender was published online on 26.12.2025 and the last date for submission is 31.12.2025 at 3.00 PM.

5. The petitioner visited the work site on 27.12.2025 and geotagged the photographs and submitted a representation to the 2nd respondent to issue a site visit certificate. As the 2nd respondent failed to issue the same, the petitioner is before this Court.

6. When Ms.P.Elakkiya made a mention regarding this matter in the forenoon I called upon her to serve the papers on the office of the Government Pleader, High Court of Madras.

7. I directed the Registry to list the case only after service on the Government Pleader. This was done in order to enable the Government Pleader to get instructions from the 2nd respondent.

8. When I called the matter post lunch, Mr.P.Gurunathan, Additional Government Pleader appears for the respondents. He had been originally instructed that the last date for issuance of site visit certificate had gone by on 24.12.2025 and that the petitioner had approached the 2nd respondent only on 27.12.2025. Ms.P.Elakkiya immediately produced the online notice issued by the 1st respondent which specifically stated that the tender itself was published on 26.12.2025. When this aspect was pointed out to Mr.P.Gurunathan, he sought for short pass over to get instructions from the 2nd respondent.

9. When the matter was called again, Mr.P.Gurunathan has produced the letter issued by the 2nd respondent, which is scanned and extracted hereunder:-



10. The instructions shows that the site visit certificate will be issued to the petitioner to enable them to participate in the tender. The proceedings of the Executive Engineer, PWD., Buildings (C&M) Division, Ranipet, is recorded. There shall be a direction to the 2nd respondent to issue the site visit certificate by 30.12.2025.

11.Accordingly, this Writ Petition is disposed of with the above directions. No costs.
