3. Summary:
The petition challenges the endorsement of a Look Out Circular (LOC) placed by the Bureau of Immigration on the petitioner’s record, which barred his overseas travel. The petitioner had been granted bail on 07.04.2026 with a condition not to leave Goa, later modified on 05.08.2026 to allow travel upon submission of itinerary details. The court held that, in view of the modified bail order, the LOC dated 02.03.2026 must be withdrawn. The Superintendent of Police and the Police Inspector were directed to inform the Immigration Authorities to delete the LOC from the system. The petitioner was reminded to strictly comply with the bail conditions. The petition was disposed of accordingly.

Judgment :-

Oral Judgment:

Valmiki Menezes, J.

1. Heard. Rule. Rule made returnable forthwith at the request of and with the consent of learned Counsel for the parties.

2. The challenge in this petition is to the endorsement on an LOC, i.e. Look Out Circular, issued by Bureau of Immigration, New Delhi at the request of Superintendent of Police dated 25.02.2026 on behalf of the Police Inspector, Fatorda Police Station, By the communication dated 25.02.2026, Superintendent of Police informed the Bureau of the pending case against the Petitioner, pursuant to which the LOC was endorsed in the immigration records, preventing the Petitioner from travelling abroad.

3. The bail was granted to the Petitioner on 07.04.2026 on several conditions, inter alia, that he should not travel out of the State of Goa without permission of the Court; this order was subsequently modified on 05.08.2026, by which the Sessions Court, Margao, in case No.3 of 2026, has granted the Petitioner conditional permission to travel, provided the Petitioner submits the travel itinerary/details. It is pursuant to this order that the Petitioner submits that the LOC recorded in the records/system of the Immigration Authorities on 02.03.2026 must be deleted to enable him to travel abroad.

4. Considering that the modification order dated 05.08.2026 now permits the Petitioner to travel abroad on certain conditions, the LOC dated 02.03.2026 recorded pursuant to the communication of the Superintendent of Police dated 25.02.2026 at behest of PI, Fatorda Police Station, must be withdrawn and cannot be permitted to remain in the record, since the Petitioner is now permitted to travel subject to submitting his travel itinerary. The LOC dated 02.03.2026 therefore cannot stand any further. The PI of the Fatorda Police Station through Superintendent of Police shall immediately communicate this order to the Immigration Authorities, who are the Respondent No.1 represented by Mr. S. Karpe, learned Advocate before this Court, to reflect the order dated 05.08.2026 modifying the bail conditions of the Petitioner. The Immigration Authorities shall thereafter remove the LOC endorsement from the system to enable the Petitioner to travel.

5. It is made clear that the Petitioner shall strictly adhere to the bail conditions in the modification order dated 05.08.2026.

6. Rule is made absolute in the above terms. Petition stands disposed of accordingly.
