(Prayer: This Crl.P. is filed u/S 438 Cr.PC (filed u/S 482 BNNS) by the advocate for the petitioner praying that this Honourable Court may be pleased to enlarge the petitioner herein on bail, in the event of her arrest in respect of fir bearing No.2/2023 registered with the respondent Cyber Crime Police Station, Cid Initially registered for the offence u/S. 66(D) of the IT Act, 2000 and subsequently modified to include Section 389, 419 and 120b r/w Sec. 34 of IPC pending on the file of 1st Addl. CMM Court, Nrupathunga Road, Bengaluru City.)
Oral Order
1. The petitioner is before this Court seeking grant of anticipatory bail for it having been turned down by the Court of Session in Crl.Misc.No.4837/2025.
2. Heard Sri. Bharath Kumar V., learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for the respondent and have perused the material on record.
3. Facts in brief, germane, are as follows:
The petitioner gets embroiled in a crime in Crime No.2/2023 for offences punishable under Sections 419, 389, 120B, 506 read with Section 34 of the IPC and Section 66(D) of the Information Technology Act, 2000. The petitioner was not drawn as an accused at the outset. The only reason that the petitioner was drawn into the web of these proceedings is a money trial. It transpires that certain amount is received to the account of the petitioner. Therefore, the petitioner is now dragged into these proceedings.
4. Learned counsel appearing for the petitioner submits that the other accused have been enlarged in bail by the Court of Session itself in Crl.Misc.No.1292/2025 dated 03.03.2025.
5. In that light, on the score of parity, the petitioner is also entitled to anticipatory bail with the same conditions that are imposed to the other accused.
6. For the aforesaid reasons, the following:
ORDER
This Criminal Petition is allowed and the petitioner is ordered to be released on bail in the event of her arrest in Crime No.2 of 2023 of Cyber Crime Police Station, CID, pending on the file of the learned I Additional CMM Court, Nrupathunga Road, Bengaluru City on the following conditions:
i) The petitioner shall execute personal bond for a sum of Rs.2,00,000/- (Rupees Two lakhs only) with one surety for the like-sum to the satisfaction of the concerned Investigating Officer;
ii) The petitioner shall appear before the concerned Investigating Officer within 15 days from the date of this order.
iii) The petitioner shall not threaten the prosecution witnesses and tamper with evidence.
iv) The petitioner shall not commit similar offences.
v) The petitioner shall co-operate in the investigation of the case.
vi) The petitioner shall not leave India without prior permission of the jurisdictional learned Magistrate for a period of 6 months from this date.
vii) The petitioner shall furnish her photo identity card for her residential address proof before the concerned Investigating Officer.
viii) In the event of violation of any of the above terms, the above bail shall stand automatically cancelled.
ix) The observations made above are only for the purpose of consideration of the application for anticipatory bail and the same shall not in any manner influence the trial. The trial Court shall consider the case on its merits and without being influenced by this order.
