1. Leave granted.

2. Challenge in this appeal is to the impugned judgment/order dated 07.07.2025 passed by the High Court at Calcutta, Circuit Bench at Jalpaiguri, in CRM (NDPS) No. 265/2025.

3. Finding that this matter is squarely covered by the order dated 18.12.2025 passed by this Court in Criminal Appeal No. 5575/2025, titled "Rahul Rahaman vs. Narcotics Control Bureau", which was passed in relation to the very same seizure of 16549 bottles of Phensedyl Cough Syrup, this Court issued notice and granted bail to the appellant, Jakir Hossain, vide order dated 12.02.2026.

4. Today, the learned counsel appearing for the Narcotics Control Bureau fairly states that he would not be filing a counter affidavit/reply in the light of the fact that the matter is squarely covered by the aforestated judgment.

5. Recording the said statement, the appeal is allowed, setting aside the impugned judgment/order for reasons alike as were mentioned in the earlier order dated 18.12.2025 passed by this Court. The order dated 12.02.2026 is made absolute.

6. The appellant shall cooperate during the course of the trial, if any, and shall not take unnecessary adjournments.

7. We clarify that we have not made any observations/comments on the merits of the case and any observation made in this order is meant only for the limited purposes of grant of bail.

8. Pending application(s), if any, shall stand disposed of.
