Judgment :-

1. Heard the learned counsel appearing on behalf of the parties.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2025 in connection with Rail (Ranchi) P.S. Case No. 35/25(N), NDPS Case No. 144 of 2025 for the offences registered under Sections 20(b) (ii) (B) of NDPS Act, pending in the court of learned Special Judge, (NDPS), Ranchi.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 7th September, 2025 and he has no criminal antecedent.

She has submitted that co-accused from whom the article was recovered which falls under intermediary quantity has been granted bail by a co-ordinate Bench of this court vide order dated 26.11.2025 in B.A. No. 10194 of 2025. She has submitted that even as per the seizure list, the seizure is not from the possession of the petitioner.

5. Learned counsel for the opposite party-State has opposed the prayer but submissions which has been advanced by the petitioner has not been disputed by the learned counsel for the State.

After hearing the learned counsel for the parties and considering the aforesaid facts and circumstances and the fact that the co-accused has been enlarged on bail and petitioner does not have any criminal antecedent as stated in paragraph 23 of the bail application, the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, (NDPS), Ranchi in connection with Rail (Ranchi) P.S. Case No. 35/25(N), NDPS Case No. 144 of 2025 on the following conditions:

                  (i) The learned court shall verify from the State with regard to criminal antecedent of the petitioner and if the petitioner has any criminal antecedent, he shall not be enlarged on bail.

                  (ii) One of the bailors would be the present pairvikar of the petitioner.

                  (iii) The other bailor should be his close relative.

                  (iv) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

                  (v) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

                  (vi) The petitioner shall fully co-operate with the proceedings before the learned court below.

7. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e- mail.

8. The instant bail application is allowed with the aforesaid conditions.
