(Prayer: Petition under Section 437/438/439/482 of Cr.P.C and 528 of BNSS praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to direct release of the Petitioner on Bail pending enquiry and trial arising out of FIR.No.32 of 2026 of Nallapadu Police Station, Guntur District., and pass)
1. This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner herein/Accused No.1, seeking regular bail, in FIR.No.32 of 2026 of Nallapadu Police Station, Guntur District, registered for the offences punishable under Sections 108 read with 3(5) of Bharatiya Nyaya Sanhita (for short “BNS”).
2. The case of the prosecution, in brief, is that the defacto complainant i.e., Jettiboyina Manikanta Sai, S/o. Venkateswarlu, Swarna Bharathi Nagar, Adavithakkelapadu Village, Guntur Rural, lodged a complaint stating that his father Jettiboyina Venkateswarlu (deceased) was got second marriage with accused No.1 and after marriage due to property and other disputes, his father committed suicide by hanging with rope at his house on 12.01.2026 at 06:00 hours due to unbearable harassment of the accused Nos. 1 to 3 and the deceased posted a video in online before committing suicide. The Accused Nos. 1 and 2 were arrested on 12.01.2026 and since then they have been in judicial custody.
3. Heard Sri S. Dilip Jaya Ram, learned counsel for the petitioner and Mr.K.Sandeep, learned Assistant Public Prosecutor on behalf of the State.
4. Learned counsel for the petitioner would submit that the petitioner herein is the 2nd wife of the deceased. The petitioner herein has nothing to do with the incident. There is no incriminating material to show the involvement of the petitioner in the alleged offence. He would further submit that the Accused No.2 was released on regular bail by this Court vide order dated 23.02.2026 in Crl.P.No.1280 of 2026 and the Accused No.3 who is the counsel of the accused No.1 was granted anticipatory bail. Therefore, he finally prays to allow the petition.
5. Learned Assistant Public Prosecutor opposed for granting bail and would submit that the investigation is pending for want of postmortem report in this matter. The petitioner herein is the 2nd wife of the deceased. There are specific overtacts against the petitioner. So far, five witnesses have been examined and hence, pray for dismissal of the petition.

Considering the submissions made and on perusal of the material placed on record, it can be seen that the case has been registered against the accused No.1 on the death of the deceased by committing suicide. The prosecution mainly relies upon a note in the handwriting of the deceased. At this stage, it would not be appropriate to decide the culpability of the petitioner by accepting the allegations. It is also brought to the notice of this Court that accused No.2 was released on regular bail on 23.02.2026 in Crl.P.No.1280 of 2026 by this Court. In view of the above said facts and circumstances, this Court is also inclined to release the petitioner on regular bail.
7. In the result, the Criminal Petition is allowed with the following stringent conditions:
i. The Petitioner/Accused No.1 shall be enlarged on bail on executing bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the learned Judicial Magistrate of First Class for Special Mobile Court, Guntur.
ii. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future.
iii. The Petitioner/Accused No.1 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the Investigating Officer as and when required.
iv. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court.
v. The Petitioner/Accused No.1 shall surrender her passport, if any, to the concerned Court. If she claims that she does not have a passport, she shall submit an affidavit to that effect to the concerned Court.
vi. The Petitioner/accused No.1 shall not leave the country without permission from the concerned Court.
vi. The Petitioner/Accused No.1 shall appear before the Station House Officer concerned once in a week i.e., on every Sunday between 10:00 am and 05:00 pm, till filing of charge sheet.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
