1. This writ petition is filed by the petitioner challenging the notice No.A/112/2026 dated 21.02.2026 issued under Section 7 of the Telangana Land Encroachment Act, 1905 in respect of the property bearing H.No.9-81, admeasuring Ac.0-01 gunta in Survey No.721, situated at Weepanagandla Village and Mandal, Wanaparthy District, as being illegal, arbitrary and unconstitutional.
2. Heard Mr. Dunna Ambedkar, learned counsel for the petitioner; Mr. L.Ravinder, learned Assistant Government Pleader for Revenue, appearing for respondents No.1, 2, 4 and 5; and perused the material on record.
3. Learned counsel for the petitioner submitted that the petitioner had been staying in the subject property since two (2) decades. The subject property has electricity service connection and there was no objection raised from any corner alleging that the land is a Government land. In fact, possession certificate was issued to the petitioner vide No.C/5568/2005 dated 11.11.2005 in the name of wife of the petitioner stating that she has been in possession and enjoyment of the subject property. According to the learned counsel for the petitioner when there is long standing possession of the petitioner, invoking provisions under the Act 1905 does not arise and the same is without jurisdiction.
4. Learned Assistant Government Pleader for Revenue submitted that the petitioner has not submitted any explanation to the notice dated 11.11.2005. That the possession certificate dated 11.11.2005 (Ex.P-2) is not valid in the eye of law and such certificate cannot be issued by Sarpanch nor the Gram Panchayat can certify the title or possession of the petitioner in respect of the subject property.

As seen from the averments in the writ affidavit,, the grievance of the petitioner appears to be that there is interference by the respondent authorities with his possession and enjoyment of the petitioner in respect of the subject property. In view of the same, this writ petition is disposed of directing the petitioner to submit explanation to the impugned notice dated 11.11.2005 within a period of seven (7) days from today. On receipt of such explanation, the respondent authorities are directed to consider the same by giving opportunity of hearing to the petitioners and to all other concerned/interested persons, and pass appropriate orders in accordance with law, within a period of two (2) weeks thereafter. Until enquiry is concluded pursuant to the said notice, the respondent authorities are directed not to interfere with the possession and enjoyment of the petitioner in respect of the property bearing H.No.9-81, admeasuring Ac.0-01 gunta in Survey No.721, situated at Weepanagandla Village and Mandal, Wanaparthy District. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in this writ petition, stand closed.
