1. The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.72 of 2025 of Vijayapuram Police Station, Chittoor District, registered against the Petitioner/Accused No.1 herein for the offence punishable under Section 109(1) read with 3(5) of Bharatiya Nyaya Sanhita, 2023.
2. Heard Mr. D. Purna Chandra Reddy, the learned Counsel for the Petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor.

The case of the prosecution in brief is that on 26.10.2025 at about 3.30 p.m., in the fields of one Nagoor Reddy situate at Ellasmudarm Village, Vijayapuram Mandal, the defacto complainant Reddivari Munaswamy, while grazing goats along with his wife, was wrongfully assaulted by accused Nos.1 and 2 along with others, that accused No.1 shouting to kill the complainant, broke a beer bottle and stabbed on his back causing bleeding injury and also caused bleeding injury to his right hand middle finger, that when his wife intervened accused No.1 caused bleeding injury to her right hand ring finger with the same beer bottle and accused No.2 kicked and beat both the complaint and his wife. The motive for the attack was previous enmity arising out of an earlier incident in which accused No.1 had attempted to steal the complainant’s cow and , when caught, developed grudge, and that after the incident the injured were shifted by the villagers to Government hospital, Vijayapuram and, on the report given, the present crime was registered.
4. Learned counsel for the petitioner would submit that the petitioner had moved an application in Crl.P. No.12605 of 2025 before the learned Single Judge of this Court, which was dismissed on 12.12.2025. The learned counsel would further submit that the wound certificates have not been placed on record till date and that, in any event, the wound certificates disclose only simple injuries. He would further submit that Accused No. 2 was released on bail by the learned Single Judge of this Court in the very same petition. The learned counsel for the petitioner would further submit that there has been a substantial change in circumstances in the matter and that the petitioner’s request may be considered, as the petitioner is ready to furnish sufficient sureties to the satisfaction of the learned Trial Court to secure his presence for the purpose of investigation.
5. Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor, would submit that the wound certificates of the injured persons shows simple injuries and that the investigation is still pending.

Considering the submissions made, upon perusal of the material on record, and taking into consideration the facts and circumstances of the case, it is noted that the earlier application filed by the petitioner was dismissed by the learned Single Judge of this Court vide order dated 12.12.2025 in Crl.P.No.12605 of 2025 on the ground that the investigation was at a crucial stage and that the wound certificates were yet to be received. In light of the present submission that the wound certificates reveal only simple injuries to the victim, this Court is inclined to allow the present petition, subject to the following stringent conditions:
i. The Petitioner/Accused No.1 shall be enlarged on bail subject to his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for the like sum each to the satisfaction of the learned Judicial First Class Magistrate, Nagari.
ii. The Petitioner/Accused No.1 shall appear before the Station House Officer, Vijayapuram Police Station, Chittoor District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court.
iii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the concerned Court.
iv. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future.
v. The Petitioner/Accused No.1 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required.
vi. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer.
vii. The Petitioner/Accused No.1 shall surrender his passport, if any, before concerned Magistrate Court. If he claims that he do not have passport, he shall submit an affidavit to that effect to the Investigating Officer.
7. Accordingly, the Criminal Petition is allowed.
