(Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to consider the representation dated 22.08.2025 submitted by the lessee of the petitioner and consequently issue the updated patta for the lands comprised in Block No.5, T.S.No.1/1 and 1/50, Venkatapuram Village, Guindy Taluk, Chennai District.)
1. This Writ Petition has been filed seeking for a Mandamus to direct the respondents to restore the patta in the name of the petitioners for the property morefully described in the prayer to this writ petition, based on the petitioners’ representation, dated 22.08.2025.
2. The petitioners claim that they are the legal heirs of the original owners of the property morefully described in the prayer to this writ petition. According to them, the original owners were issued patta by the revenue authorities for the property morefully described in the prayer to this writ petition, but however, according to the petitioners, arbitrarily, without issuing any notice to them, the classification for the property morefully described in the prayer to this writ petition, has now been changed to “river poromboke” and therefore, the petitioners through their representation, dated 22.08.2025 seek for restoration of the patta in their name and re-classification of the property morefully described in the prayer to this writ petition, as “patta lands” owned by the petitioners. Since the representation dated 22.08.2025 referred to supra has not been considered by the respondents, the petitioners have filed this writ petition.
3. A counter has been filed by the respondents stating that the property morefully described in the prayer to this writ petition has now been classified as “river poromboke”, since it falls in a water body.
4. However, it is an admitted fact that, till date, no final orders have been passed by the respondents on the petitioners’ representation, dated 22.08.2025 referred to supra. It is also an admitted fact that the petitioners are the legal heirs of the original owners who were issued with the patta in their name for the property morefully described in the prayer to this writ petition.

The learned Senior Counsel appearing for the petitioners would submit that only if a final order is passed by giving reasons as to why patta cannot be issued to the petitioners based on the petitioners’ representation, dated 22.08.2025, the petitioners will be in a position to challenge the same by raising appropriate grounds in the manner known to them under law. When it is an admitted fact that the petitioners’ representation, dated 22.08.2025 seeking for restoration of the patta and for re-classification of the property as patta land was not considered by the respondents prior to the filing of this writ petition, this Court in the interest of justice to get clarity, deems it fit to direct the 5th respondent to pass final orders on merits and in accordance with law, on the petitioners’ representation, dated 22.08.2025 seeking for issuance of updated patta, by re-classifying the property morefully described in the prayer to this writ petition as patta lands instead of “river poromboke”, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioners’ representation, dated 22.08.2025.

Even though a counter has been filed by the respondents before this Court stating that the property is classified as “river poromboke” and patta cannot be issued in favour of the petitioners, this Court, as observed supra in the interest of justice, to enable the petitioners to know through a speaking order, in case, the 5th respondent rejects the petitioners’ representation seeking for issuance of updated patta by re-classifying the property as patta land instead of “river poromboke”, is inclined to direct the 5th respondent to consider the petitioners’ representation, dated 22.08.2025, on merits and in accordance with law, within a time frame to be fixed by this Court.

For the foregoing reasons, this Court directs the 5th respondent to pass final orders, on merits and in accordance with law, on the petitioners’ representation, dated 22.08.2025 seeking for issuance of updated patta for the property morefully described in the prayer to this writ petition and for reclassification of the subject property as “patta land” instead of “river poromboke”, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
8. With the aforesaid direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
