1. Leave granted.
2. The appellant, Aijul Sheikh, is before this Court aggrieved by the judgment and final order dated 07.11.2025 passed by the High Court at Calcutta, denying him regular bail in connection with Case/First Information Report (FIR) No. 475/2024 dated 01.12.2024 registered with Police Station - Sagarpara, Murshidabad, West Bengal, for the offences punishable under Sections 21(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1989["NDPS Act", for short].
3. The case against the appellant, Aijul Sheikh, is in relation to the seizure of 700 bottles of cough syrup, namely, Phensedyl. The chargesheet has already been filed. However, charges are yet to be framed and the date in that regard has been fixed as 22.01.2026.
4. The appellant, Aijul Sheikh, has been in Berhampore Central Correctional Home since 06.12.2024.
5. Considering the above facts and as the chargesheet has already been filed, we find no reason to continue the incarceration of the appellant, Aijul Sheikh, at this stage.
6. The appeal is accordingly allowed, setting aside the impugned judgment/order passed by the High Court.
7. The appellant, Aijul Sheikh, shall be released on bail in connection with the aforestated FIR, on such appropriate terms and conditions as may be fixed by the Special Court.
8. The appellant shall cooperate during the course of the trial and shall not take unnecessary adjournments.
9. We clarify that we have not made any observations/comments on the merits of the case and any observation made in this order is meant only for the limited purpose of grant of bail.
10. Pending application(s), if any, shall stand disposed of.
