1. All the parties have appeared by filing Vakalatnama.
2. Today, learned counsel representing opposite party No.1 is present. The others are absent.
3. This Civil Misc. Petition has been preferred for restoration of Second Appeal No.120 of 2017 to its original file, which was dismissed for non-compliance of the peremptory order dated 13.08.2019, for removing all the defects.
4. Learned counsel representing the petitioners submits that no sooner the Second Appeal is restored to its original file, he will remove the surviving defects.
5. Learned counsel representing the opposite party does not oppose the aforesaid submission.
6. Considering the submission of learned counsel representing the petitioners, this Civil Misc. Petition stands allowed.
7. The Second Appeal No.120 of 2017, is restored to its original file with a condition the defect, if any, is still not removed, the same shall be removed within four weeks, otherwise this order will not be given effect to.
