Oral Order

1. Heard Mr. Shreyas Reddy, learned counsel for the petitioner herein - plaintiff.

2. This Civil Revision Petition is filed under Article - 227 of the Constitution of India, challenging the docket order dated 27.01.2026 passed by learned II Additional Junior Civil Judge-cum-XIII Additional Judicial Magistrate of First Class, Medchal - Malkajgiri District at Kukatpally.

3. The petitioner herein has filed a suit in O.S. No.10 of 2026 against the respondents for perpetual injunction restraining them or their authorized employees on behalf of the Company from acting upon the Offer Letter dated 08.01.2026 in respect of issuance of shares 20,92,628 to increase the subscribed and paid-up capital of the Company by fixing the date as 27.01.2026 without following due process of law. He has also filed an Interlocutory Application under Order - XXXIX, Rules - 1 and 2 of CPC vide I.A. No.10 of 2026.

On 20.01.2026, learned trial Court issued urgent notice to the respondents and posted the matter to 23.01.2026, on which date the respondents entered their appearance and received copies of the documents. They sought time to file counter. Therefore, the matter was adjourned to 27.01.2026, on which date, the respondents filed counter and both the parties partly argued the matter. Learned trial Court posted the said I.A. to 02.02.2026 for hearing.

5. Challenging the said order, the petitioner filed the present revision contending that if the interest of the petitioner is not protected, the very suit will become infructuous. Last date for share subscription and payment of share amount pursuant to the offer letter dated 08.01.2026 is 27.01.2026. Even then, learned trial Court is not protecting the interest of the petitioner. Therefore, he has filed the present revision.

As discussed above, the petitioner filed the aforesaid suit for perpetual injunction against the respondents restraining the respondents or their authorized employees on behalf of the Company from acting upon the Offer Letter dated 08.01.2026 in respect of issuance of shares 20,92,628 to increase the subscribed and paid-up capital of the Company by fixing the date as 27.01.2026 without following due process of law. On 20.01.2026, the learned trial Court ordered notice in I.A. No.10 of 2026 filed by the petitioner. The respondents entered their appearance on 23.01.2026 and also filed counters. On 23.01.2026, learned trial Court heard both the parties partly and posted the matter to 02.02.2026.

In the light of the aforesaid discussion, this revision is disposed of directing II Additional Junior Civil Judge-cum-XIII Additional Judicial Magistrate of First Class, Medchal - Malkajgiri District at Kukatpally, to dispose of I.A. No.10 of 2026 in O.S. No.10 of 2026, strictly in accordance with law, as expeditiously as possible. In the circumstances of the cases, there shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the revision shall stand closed.
