1. By means of the present Criminal Misc. Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant has sought quashing of the Charge Sheet dated 03.06.2023, Cognizance Order and Summoning Order dated 04.04.2024, passed by the court of Chief Judicial Magistrate, Udham Singh Nagar along with the entire proceedings of Criminal Case No.1050 of 2024, State of Uttarakhand Vs. Kishan Pal, pending in the court of Additional Chief Judicial Magistrate/Second Additional Civil Judge (S.D.), Rudrapur, District Udham Singh Nagar, whereby the applicant was summoned to face the trial for the offences punishable under Sections 353, 354, 504 and 506 IPC. The instant criminal misc. application is accompanied with a compounding application, which is duly supported by the affidavits of the applicant and the respondent no.2/complainant/ injured.

2. Heard learned counsel for the parties and perused the record.

3. The applicant and the respondent no.2, duly identified by their respective counsel are present in person before the Court. On an interaction with the respondent no.2, she has made a statement that she does not wish to pursue the case any further and wishes for putting a quietus to the matter.

4. The parties also made a statement that they solemnized their marriage on 11.03.2025 and the Marriage Certificate is enclosed as Annexure No.5 to the criminal misc. application.

5. In that view of the matter and in view of the joint compromise entered between the parties, the Compounding Application (IA) No.1 of 2026, is hereby allowed.

6. The entire proceedings of Criminal Case No.1050 of 2024, State of Uttarakhand Vs. Kishan Pal, pending in the court of Additional Chief Judicial Magistrate/Second Additional Civil Judge (S.D.), Rudrapur, District Udham Singh Nagar are hereby quashed.

7. Urgency Application (IA) No.1 of 2026 and Compounding Application (IA) No.2 of 2026 are disposed of accordingly.
