District and Sessions Judge at Ramanagara pertaining to the Magadi Police Station for the offence punishable under Sections 143,147,148, 120-B,364,302,201 r/w Sec.149 of IPC Act.)

Oral Order

1. This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in Crime No.224/2015 of Magadi Police Station pending in S.C.No.77/2024 on the file of III Additional District and Sessions Judge, Ramnagar registered for offences punishable under Sections 143, 147, 148, 120B, 364, 302, 201 read with Section 149 of IPC.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent -State.

3. The petitioner has been granted bail as per order dated 08.03.2017 in Crl.P.No.7586/2016 and he has been released on 12.04.2017. Thereafter, he remained absent, NBW and proclamation have been issued. Subsequently, he got recalled the said NBW. The petitioner again remained absent. NBW has been executed and he has been produced on 23.09.2019 and subsequently he has been granted bail on 04.03.2020. Thereafter, he remained absent and case against him has been split up and split up case has been registered in S.C.No.77/2024. In the said case, he has been arrested by executing NBW on 16.08.2025. Since then, he is in judicial custody.

4. Learned counsel for petitioner would contend that the petitioner was in judicial custody in S.C.No.206/2020. Therefore, he could not to be present in the earlier case.

5. The petitioner remained absent from 27.03.2024 till he was secured under NBW. Learned counsel for the petitioner submits that due to health issue he could not be present before the Court. She further submits that the petitioner has now deposited Rs.50,000/- towards forfeited bond amount in S.C.No.77/2024 on 31.01.2026. The petitioner has undertaken to appear before the trial Court on all dates of hearing and abide by any conditions to be imposed by this Court. Considering the above aspects, the petitioner has made out case for grant of bail with conditions.

7. In the result, the following

ORDER

          i) The petition is allowed.

          ii) The petitioner is granted bail in Crime No.224/2015 of Magadi Police Station pending in S.C.No.77/2024 on the file of III Additional District and Sessions Judge, Ramnagar registered for offences punishable under Sections 143, 147, 148, 120B, 364, 302, 201 read with Section 149 of IPC subject to following conditions:

          a) The petitioner -accused No.2 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the trial Court.

          b) The petitioner -accused No.2 shall not tamper the prosecution witnesses either directly or indirectly.

          c) The petitioner -accused No.2 shall appear before the trial court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.

          The amount deposited by the petitioner in sum of Rs.50,000/- is to be appropriated to the State towards forfeited bond.
