[1] Heard learned counsel of both sides.

[2] The son of the present petitioner, namely Sri Arjun Chandra Majumder, went on superannuation on 31.10.2024 as Panchayet Supervisor, and thereafter, he died on 14.01.2025, leaving behind him the petitioner (mother), his wife (respondent no.4) and one son (respondent no.5). During his lifetime, said Sri Arjun Chandra Majumder, received the amount payable to him under Gratuity, Leave Salary and GPF, but the benefit under the Group Insurance Scheme was not disbursed.

[3] Learned counsel for the petitioner, Mr. D.K. Das Chawdhury, submits that the petitioner, being the mother of the deceased, is entitled to 1/3rd of the amount of Rs.77,473/- payable under the Group Insurance Scheme. Learned counsel, Mr. D.K. Das Chawdhury, also submits that his client has no claim regarding family pension of the deceased.

[4] Learned Senior Government Advocate, Mr. P. Gautam, submits that the department is ready to disburse the said amount, but some objections were raised by respondent no.4 not to disburse the same due to the pendency of this writ petition, so the same could not be disbursed earlier.

[5] Learned counsel, Mr. Samarjit Bhattacharjee, representing respondent nos.4 and 5, also submits that they have no objection if 1/3rd of the said amount payable under the Group Insurance Scheme is disbursed to the petitioner.

[6] Considered the submissions of both sides and also perused the record. In view of submissions made by learned counsel of all the sides, the instant writ petition is disposed of with a direction to the respondent nos.1 to 3 to release 1/3rd of the amount payable under the Group Insurance Scheme to the petitioner and the rest of the amount to respondent nos.4 and 5. The entire process should be completed within 2(two) months from the date of receipt of a copy of this order.

Pending application(s), if any, also stands disposed of.
