The main writ petition will be taken up for disposal in due course of time. However, the present applicant has filed this writ petition seeking some reliefs and along with the writ petition this present I.A. is filed for directing the respondents to allow the applicant to leave the station and to participate in the meeting of the Pharmacy Council of India scheduled to be held on 23.01.2026 at New Delhi.
In course of hearing, Learned Senior Counsel, Mr. P. Roy Barman appearing for the applicant drawn the attention of the Court that the Under Secretary, University Grants Commission (UGC) by a communication dated 16.07.2024 (Annexure-5) addressed to the Deputy Secretary, Pharmacy Council of India that the present applicant has been nominated as UGC representative under clause 3(a) of Pharmacy Act, 1948 on the Pharmacy Council of India along with another person.
Learned Senior Counsel, Mr. P. Roy Barman further drawn the attention of the Court that, by another communication Registrar-cum-Secretary of Pharmacy Council of India addressing to all the State Governments under UTs dated 09.06.2022 informed to allow the nominated members to attend the meetings of the Pharmacy Council of India as and when requires being a statutory body.
Learned Senior Counsel, Mr. P. Roy Barman again submitted that the Government of Tripura, Health & Family Welfare Department by another notification dated 20.07.2023 informed that the teaching faculties entrusted to the work of the regulatory authorities may be required to attend the meetings of Pharmacy Council of India and other statutory bodies and their leave will be treated as official duty. But inspite of those orders whenever the present applicant approached for leave to the authority to attend the meeting of Pharmacy Council of India in all the occasions the respondent authority with an ulterior motive dismissed or rejected the representation or application filed by the present applicant rather with an ulterior motive the respondent authority contemplated to initiate departmental proceeding against the present applicant for which the applicant has been compelled to seek redress before this Court by filing the writ petition.
The matter is already been heard and notice has already been issued to the respondents in this regard.
However, Learned Senior Counsel further submitted that the next meeting of the Pharmacy Council of India is scheduled to be held on 23.01.2026 at New Delhi but to attend the meeting the applicant has not approached the Authority seeking station leave permission on the ground that like earlier occasion also without any cogent grounds his writ petition will be rejected with an ulterior motive. But, since the applicant has approached this Court by filing writ petition, so Learned Senior
Counsel urged before this Court to allow the applicant to attend the meeting scheduled to be held on 23.01.2026 at New Delhi.
Learned Addl. G.A., Mr. Karnajit De appeared on behalf of the respondent Nos.1-4 and submitted that by this time for leaving the station without any permission of the Authority already one Memo dated 15.02.2025 has been issued against the applicant by the authority and the matter is now pending for adjudication and in such a situation at this stage there is no scope to grant any interim relief to the applicant. Rather Learned Addl. G.A. urged before the Court to permit the State-respondents to file an objection against the I.A. filed by the present applicant.

Heard both the sides at length and perused all the documents submitted by the applicant in the main writ petition.
It appears that the present applicant was duly nominated by the UGC as a Member of the Pharmacy Council of India for which no ‘NOC’ was required. Even to attend the meeting of Pharmacy Council of India no ‘NOC’ is also required. However, whenever the present applicant approached to the Authority seeking station leave permission in all the occasions without any cogent reasons, his petitions were rejected by the Authority raising some technical grounds which appears to this Court is very much unwarranted and arbitrary. As such the applicant was restrained from approaching furthermore to the Authority by submitting petition seeking permission to leave the station to participate in the next meeting of the Pharmacy Council of India scheduled to be held on 23.01.2026 at New Delhi.
Thus, it appears to this Court that the respondents without any cogent grounds restrained the applicant from participating or attending any of the meetings of the Pharmacy Council of India which appears to be arbitrary and unjustified.
So considering all, at this stage I do not find any scope to allow time to the State-respondents to file any objection. The respondents shall at the liberty to file their counter-affidavit in the main writ petition. However, considering the urgency the respondents are hereby asked to allow the applicant to participate in the next meeting of the Pharmacy Council of India scheduled to be held on 23.01.2026 which shall be treated as an official duty.
With this observation, this present I.A. stands disposed of.
A copy of this order be communicated to the Learned Senior Counsel appearing for the petitioner and also a copy of this order be supplied to Learned Addl. G.A. appearing for the respondents in course of the day for information and intimation to the Authority also.
