“… to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents No.2 to 4 in not considering my objection application dt.03.11.2025, as illegal, arbitrary, against the principles of natural justice and also violative of Articles 14 and 300-A of Constitution of India and consequently Direct the respondents no.2 to 4 not to grant any mutation proceedings claiming through succession in favour of the unofficial respondents 5 to 8 basing on the applications made online vide application Nos.RC2500006195 and RC2500006196 dated 30.07.2025 and RC2500007563, RC2500007564, RC2500007565 & RC2500007566 dt.01.09.2025, in the interest of justice and to pass such other or orders …”
2. Heard Mr.Dammalapati Srinivas, learned senior counsel representing Ms.Pillix Law Firm for the petitioner and Mr.K.Mahesh, learned Assistant Government Pleader for Revenue representing learned Government Pleader for Revenue appearing for respondent Nos.1 to 4. Perused the record.
3. Learned counsel for the petitioner submits that the unofficial respondent Nos.5 to 8 have filed on-line applications bearing Nos.RC2500007563, RC2500007564, RC2500007565 & RC2500007566 dated 01.09.2025 seeking to mutate their names in the revenue records with regard to the property obtained through succession; that the petitioner has filed a representation before respondent No.4/Tahsildar requesting him not to entertain any succession proceedings in favour of third parties, without challenging the existing succession proceedings in File No.D/3400/2005 dated 27.10.2006.
4. He further contends that a civil suit vide O.S.No.139 of 2025 filed by the petitioner for the relief of Specific Performance is pending adjudication on the file of the learned XV Additional District Judge, Ranga Reddy District, at Ibrahimpatnam (for short, “the trial Court”); that vide order dated 02.07.2025 in I.A.No.674 of 2025 the trial Court had granted ad-interim Injunction restraining the defendants from interfering with the suit schedule property.
5. He submits that the petitioner has filed W.P.No.26676 of 2025 before this Court. Vide order dated 08.09.2025 this Court directed as follows:-
“Pending further orders, there shall be interim direction to the respondent No.4 not to entertain any document for registration presented by the unofficial respondent Nos.7 to 9 in connection with the petitioner’s agricultural lands/ residential plots situated in Sy.No.98 (as per Village Map 479) admeasuring Ac.20-00 guntas and Sy.No.99 (as per Village Map 480) admeasuring Ac.19-20 guntas, total admeasuring Ac.39-20 guntas situated at Kongara Khurd (A) Village, Maheshwaram Mandal, Ranga Reddy District in view of the injunction order dated 02.07.2025 passed in I.A.No.674 of 2025 in O.S.No.139 of 2025 on the file of XV Additional District and Sessions Judge, RangaReddy District, at Ibrahimpatnam.”
Therefore, he contends that if the official respondents act upon the on-line applications submitted by unofficial respondent Nos.5 to 8 the valuable right of the petitioner under Article 300 of Constitution of India would be infringed and hence, seeks to pass appropriate orders.
6. Learned Assistant Government Pleader for Revenue states that the case of the petitioner is under consideration and upon examining the representation dated 03.11.2025 submitted by the petitioner, appropriate orders would be passed on the on-line applications submitted by unofficial respondent Nos.5 to 8. Stating thus, he seeks to dismiss the Writ Petition.
7. Having regard to the submissions of both the learned counsel and on perusal of the material available on record, this Court, without making any observations on the merits or demerits of the case, deems it appropriate to direct the official respondent No.4 to examine the representation dated 03.11.2025 submitted by the petitioner and pass appropriate orders, strictly in accordance with law, by issuing notices to all the interested parties and affording them sufficient opportunity of hearing. Since, notice is directed to be issued on unofficial respondent Nos.6 to 9 further service of notice upon respondent Nos.6 to 9 stands dispensed with.
8. With the above direction this Writ Petition is disposed of. No costs.
Miscellaneous petitions pending, if any, shall stand closed.
