(Prayer: Contempt Petition filed under Section 11 of the Contempt of Court Act, 1971, to initiate contempt proceedings against the contemnors and punish them for the willful disobedience of the order of this Court made in Crl.O.P.(MD)No.17500 of 2024 dated 16.10.2024.)
1. The Contempt Petition has been filed to punish the respondents for their wilful disobedience of the order passed by this Court in Crl.O.P. (MD)No.17500 of 2024 dated 16.10.2024.
2. When the matter is taken up for hearing today, the respondents are present. Counter affidavits of the respondents filed.
3. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Criminal Side) appearing for the respondents 1 and 2 and the learned counsel appearing for the third respondent.

It is seen from the records that this Court vide order dated 16.10.2024, taking note of the submission made by the learned Government Advocate (Criminal Side) that investigation has already been completed and charge sheet was made ready, directed the respondent police to file the final report before the jurisdictional Court within a period of two weeks from the date of receipt of a copy of that order.

The learned counsel appearing for the petitioner would submit that they have filed an application seeking copies of the charge sheet but that was returned stating that no charge sheet was filed and that thereafter, they have issued a contempt notice and since the same was not complied with, the present contempt petition came to be filed.

When the matter was taken up earlier, considering the submission made by the learned Government Advocate (Criminal Side) that charge sheet was filed through e-filing on 31.01.2024 but the same was taken on file on 19.07.2025 in C.C.No.46 of 2025 on the file of the Court of Judicial Magistrate, Aranthangi, this Court directed the Registry to call for a report from the learned Magistrate as to when the charge sheet was filed and when the same was taken on file. In pursuance of the direction of this Court, the learned Judicial Magistrate, Aranthangi, submitted a report on 31.12.2025 stating that charge sheet was filed through e-filing portal on 21.10.2024 but charge sheet was returned on 28.10.2024 as the final report was not uploaded in proper format and that subsequently, final report was resubmitted on 19.07.2025 and the case was taken on file in C.C.No.46 of 2025 on the same day.
7. The respondents, in their counter affidavits, tendered unconditional apology for not complying with the order of this Court within the time stipulated. But the fact remains that charge sheet was already taken on file and is pending for appearance of the accused.
8. Recording the unconditional apology tendered by the respondents, this Court is inclined to close the contempt petition. Accordingly, this Contempt Petition stands closed.
