1. These transfer petitions have been filed under Section 406 of the Code of Criminal Procedure, 1973 (for short "CrPC"). The petitioner herein is wife of respondent no.1 in both the petitions.
2. The petitioner has filed Transfer Petition (Crl.) Nos.526 and 527 of 2025 seeking the following reliefs:
Transfer Petition (Crl.) No.526 of 2025
"a. Transfer COMA No.92 of 2022 titled as "Shefali Verma Versus Nitish Ahuja and Ors." pending before the Chief Judicial Magistrate, District Court, Jind, Haryana to the Court of Chief Judicial Magistrate, Central District, Tis Hazari Court, New Delhi.
b. Pass such further or other order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case and for the ends of justice."
Transfer Petition (Crl.) No. 527 of 2025
"a. Transfer the MNT No.99 of 2022 titled as "Shefali Verma Versus Nitish Ahuja" pending before the Principal Judge, Family Court, District Court, Jind, Haryana to the Court of Principal Judge, Family Court, Central District, Tis Hazari Court, New Delhi.
b. Pass such further or other order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case and for the ends of justice."
3. We have heard learned counsel for the petitioner and learned counsel for the respondent(s).
4. Having heard learned counsel for the respective parties and on perusal of the material on record, we find that the petitioner has made out a case for transfer of the aforesaid petitions.
5. In the result, the transfer petitions are allowed and COMA No.92 of 2022 pending before the Chief Judicial Magistrate, District Court, Jind, Haryana is ordered to be transferred to the Court of Chief Judicial Magistrate, Central District, Tis Hazari Court, New Delhi and MNT No.99 of 2022 pending before the Principal Judge, Family Court, District Court, Jind, Haryana is ordered to be transferred to the Court of Principal Judge, Family Court, Central District, Tis Hazari Court, New Delhi.
6. However, liberty is reserved to the respondent(s) to appear before the transferee court in the aforesaid matters through video conferencing facility. If such a request is made, the concerned court shall make available video conferencing facility to the respondent(s) herein.
7. Registry to communicate this order to the transferor as well as the transferee courts for taking steps in accordance with this order.
