(Prayer: This writ petition filed under article 226 of the Constitution of India to issue a writ of mandamus by calling for the entire records pertaining to the order dated 3.11.2025 in Pa. MU. No 9598 / 2023 / A1 of the 3rd respondent, inquire into the same and quash the same and direct the 4th respondent to conduct the Aravan festival in the temple called A/m Aravaan Temple and A/m kundathu Magakali Amman Temple situate at Kuruchi Village, Madhukkarai Taluk, Coimbatore District by following the prevailing customary practices therein.)
1. Challenging the impugned order passed by the third respondent directing the conduct of the Aravan Festival as per the procedure under the Hindu Religious and Charitable Endowments Act and also under the control of the Tahsildhar, the present writ petition has been filed.

The learned counsel for the petitioner would submit that this Court, by order dated 07.10.2025, made in W.P.(Crl).No.984 of 2025, dated 07.10.2025, directed the third respondent/Revenue Divisional Officer(RDO) to conduct an enquiry and take a decision. It was further directed that if the parties were agreeable to the decision, the festival shall be conducted harmoniously. If the parties were not willing to accept the decision of the RDO, the festival shall be conducted by the Tahsildar and not by the parties.
3. Pursuant to the said direction, the enquiry has been conducted by the 3rd respondent/RDO. However, instead of directing the 4th respondent/Tahsildar to conduct the festival, the 3rd respondent/RDO passed the impugned order stating that the festival shall be conducted by the 4th respondent/Tahsildhar along with the HR & CE Department.
4. According to the petitioner, the temple in question is a private temple and not under the control of HR & CE Department, and no proceedings have been initiated by the HR & CE Department. Therefore, the direction of the third respondent involving the HR & CE Department to conduct the festival is not sustainable. However, the petitioner has expressed willingness to abide by the remaining portion of the order passed by the third respondent, namely, the festival shall be conducted by the Tahsildar.
5. Mr. S.Ravichandran, learned Additional Government Pleader, appearing for the respondents 1 and 2 would submit that HR & CE Department is not inclined to take control over the temple, as it is a private temple and that they have no objection to the festival being conducted by the Tahsildar.
6. Heard the learned counsel appearing on both sides and perused the materials placed on record.
7. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
8. In view of the above submissions and considering the fact that the HR & CE Department has no inclination to take over the temple, the temple festival shall be conducted by the 4th respondent/Tahsildar, as ordered by the 3rd respondent/RDO, to which the petitioner has also expressed no objection.
9. Accordingly, the 4th respondent/Tahsildar is directed to conduct the temple festival.
10. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
