Oral Order

1. This petition filed under Section 483 of BNSS praying to grant bail in Crime No. 160/2025 of Azad Nagar Police Station, Davanagere registered for offence under Sections 109(1), 115(2), 189(2), 191(2), 191(3), 190, 54, 351(3), 352 and 351(2) of BNS.

2. Heard learned counsel for petitioner and learned HCGP for respondent - State.

3. Learned counsel for petitioner would contend that the overt act alleged against the petitioner is assault with Club on the hand and causing injury to the left hand little finger. Said assault is not on the vital part of the body. The injured has been discharged from the hospital. Petitioner is M.Tech. graduate working in Bengaluru. As major portion of the investigation is over, petitioner is not required for further custodial interrogation. With this, he prayed to allow the petition.

4. Per contra, learned HCGP would contend that serious overt act of assault is alleged against the petitioner. The injured has sustained 5 injuries. Statement of the injured has been recorded in the hospital while he was admitted there for treatment. Investigation is in progress. With this, he prayed to reject the petition.

5. Having heard learned counsel for the parties this Court has perused the complaint, FIR and other materials placed on record.

6. On the statement of injured recorded in the hospital case has been registered against the accused persons in Crime No. 160/2025 of Azad Nagar Police Station for the aforesaid offences. Petitioner has been arraigned as accused No. 3 in the FIR. As per the averments of the complaint the overt act alleged against the petitioner is that when he made attempt to assault the injured with club on his face, he put his left hand and sustained injury to his left hand little finger. As per discharge summary made available by the learned HCGP, the injured has sustained a cut lacerated wound measuring 2X1 cm over his left little finger. Said injury is a simple injury. The assault made by the petitioner is not on vital part. Petitioner is in judicial custody since 26.11.2025. As major portion of the investigation is over, he is not required for further custodial interrogation. There are no criminal antecedents of the petitioner.

7. Considering the above aspects, petitioner has made out case for grant of bail with conditions.

8. In the result, following;

ORDER

          Petition is allowed. Petitioner is granted bail in Crime No. 160/2025 of Azad Nagar Police Station, Davanagere subject to following conditions:

          I. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the jurisdictional Court.

          II. Petitioner shall not tamper the prosecution witnesses either directly or indirectly.

          III. Petitioner shall attend the trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case.

          IV. Petitioner shall not involve in commission of any offence. If the petitioner is found involved in commission of any offence, the prosecution is at liberty to seek cancellation of bail granted to him.
