Heard Mr. S. Lodh, learned counsel appearing for the appellant. Also heard Mr. S. Bhattacharjee, learned counsel appearing for the respondent.
This court vide its Order dated 04.11.2025 had referred the matter for ‘mediation’.
In compliance of the said order, the Mediator of the Mediation Centre, High Court of Tripura, had submitted the mediation report on 16.12.2025 before this court, which has been placed on record.
Perused the same.
Learned counsel for the parties have submitted that the parties to the lis have settled their disputes amicably in course of mediation, and the case may be disposed of in terms of the said mediation report.
The terms and conditions as laid down in the mediation report, are as follows:
(i) The child, Aditya Sen shall remain and stay with his father i.e. Sri Bappa Sen;
(ii) The mother of the child, Smt. Arpita Das, shall have full visitation right of their child;
(iii) The child and the mother, Smt. Arpita Das shall communicate regularly over telephone;
(iv) Smt. Arpita Das and Sri Bappa Sen shall also communicate with each other regarding the well being of the child;
(v) Smt. Arpita Das shall withdraw custody case against the father i.e. Sri Bappa Sen and Sri Bappa Sen shall have the custody of the child;
(vi) Smt. Arpita Das shall have right to enquire from school authority about the well being and progress of the child i.e. Aditya Sen and in such case, Sri Bappa Sen shall have no objection;
(vii) Smt. Arpita Das shall have right to attend one parent-teacher meeting at school and Sri Bappa Sen shall have right to attend rest of all the parent-teacher meetings;
(viii) Sri Bappa Sen shall share school ID and all result sheets of the child with Smt. Arpita Das.
In terms of the mediation report dated 16.12.2025, the present appeal stands disposed of.
The mediation report dated 16.12.2025 shall be made a part of the decree.
Registry is directed to prepare the decree accordingly.
