Judgment :-

1. This application has been filed for quashing the entire proceedings of Criminal Case No.5260 of 2021, pending before the court of learned Ist Additional Judicial Magistrate, Haldwani, District Nainital under Sections 323, 498A, 506 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961.

3. Mrs. Sweta Badola Dobhal, learned Brief Holder for the respondent No.1.

4. Ms. Suraiya Naaz, learned counsel for the respondent no.2-informant.

5. The applicant no.1 is the husband of the respondent no.2-informant. The applicant no.2 is the mother and the applicant no.3 is the sister of the applicant no.1. Applicants are present in-person. They are identified by Mr. Lalit Sharma, Advocate.

6. The respondent no.2 is present in-person. She is identified by Ms. Suraiya Naaz, Advocate.

7. Both, the applicants and the respondent no.2 submitted that there were matrimonial disputes between them. They have resolved their disputes. After resolving their disputes, they have field a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. The respondent no.2 has requested to quash the entire proceedings of the said Criminal Case No.5260 of 2021.

8. Mrs. Sweta Badola Dobhal, Brief Holder has not opposed the said request.

9. It is noticed that the parties have resolved their matrimonial disputes amicably. Therefore, it is a case, in which the inherent jurisdiction of this Court should be exercised to do real and substantial justice.

10. Consequently, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.5260 of 2021, pending before the court of learned Ist Additional Judicial Magistrate, Haldwani, District Nainital, are hereby quashed.
