1. Heard the parties.
2. By filing this Criminal Miscellaneous Petition, the petitioner prays for restoration of Criminal Appeal (D.B.) No.122 of 2023, which was dismissed peremptorily, as the defects were not removed as per the direction of this Court vide order dated 10.06.2024.
3. Ms. Suman Roy, learned counsel appearing on behalf of the petitioner undertakes to remove the defects, as pointed out by the office within two weeks. She also submitted that she will ensure that the appellant-petitioner does not remain unrepresented during pendency of Criminal Appeal (D.B.) No.122 of 2023.
4. In view of the aforesaid submission, Criminal Appeal (D.B.) No.122 of 2023 is restored to its original file.
5. Learned counsel representing the petitioner is directed to remove the defects as pointed out by the office, within two weeks.
6. Accordingly, this Criminal Misc. Petition stands allowed.
7. It is made clear that if the defects pointed out by the office is not removed within the aforesaid period, this order will not be given effect to.
8. Let learned counsel Mr. Deepak Kumar and Ms. Suman Roy, be appointed as Amicus Curiae in Criminal Appeal (D.B.) No.122 of 2023, to assist the Court at the time of final hearing. Their name be reflected in the cause list as such.
