Judgment :-

1. Heard learned counsels for petitioner and for State.

2. The petitioner is apprehending his arrest in connection with Jaldega P.S. Case No.60 of 2025, for offence registered under section 317(5), 3(5) of BNS, 2023, and section 11(i)(a), 11(i)(d) of Prevention of Cruelty to Animals Act and section 1291) and (2) of Jharkhand Bovine Animals Prohibition of Slaughter Act, 2005, pending in court of learned Sub Divisional Judicial Magistrate, Simdega.

Learned counsel for petitioner submits that the petitioner’s name has come on confessional statement and the petitioner has nothing to do with the vehicle in question and the allegations are made that on the Scorpio vehicle the bovine animals were being carried. He further submits that the petitioner has got one criminal antecedent and that has come in the order of the learned Sessions Judge.

4. Learned State counsel opposes prayer and submits that the petitioner is having one criminal antecedent.

Considering that name of the petitioner has come on confessional statement and it has been pointed out that the petitioner has nothing to do with the vehicle in question as well as the bovine animals and further the criminal antecedent cannot be the sole criteria for allowing or rejecting the anticipatory bail or the regular bail, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Simdega, in connection with Jaldega P.S. Case No.60 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
