1. The 1st accused in VC.No.1/2015/NRK of VACB, Kozhikode, has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to quash FIR and all further proceedings against the petitioner in the above crime.
2. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor. Perused the report of the Inspector of Police, VACB, Kozhikode, dated 29.11.2025.
3. The relevant portion of the report dated 29.11.2025, reads as under:
“The investigation of VC-01/2015/NRK was completed. The allegations raised in this case are the renovation works done in the Taluk Government Nadapuram, Kozhikode. During the investigation, the following facts were revealed. The first accused Shri.Dr.Lalu Jones R, without any technical knowledge or expertise related to the work, granted the completion certificate. The second accused, NRHM engineer, Shri.K.Faisal, who was responsible for checking the measurement book and ensuring proper work, did not inspect the works properly, failed to inform superiors about defects, and abused his official position. The third accused, Electrical Engineer, Shri.Shalu V.in charge of the electrical renovation work at Taluk Government Hospital, Nadapuram, showed a sum of Rs.4,60,632/- as work done for those who had not done it and misused his official position by additing the measurement to the seventh and final bill. The fifth accused, Senior Civil Engineer Mr.Bibish C.K., in charge of the civil renovation works of Taluk Government Hospital, Nadapuram during the said period abused his official position by showing civil works worth Rs.2.06,547/- as done in the measurement from Part II to VII bills which were not actually done. Through the actions of the 1st, 2nd, 3rd and 5th accused, the contractor Mr.U.Mohanan, the 4th accused gained undue financial profit causing a total financial loss of Rs.6,67,179/- to the government. The accused have committed an oflence punishable under Sections U/S 13 (1) (d) (ii) r/w 13(2) of the Prevention of Corruption Act, 1988.
The contractor (A4) was abled to encashed the bill and receive the payment only because Dr.Lalu Jones R (A1), the Superintendent, Taluk Government Hospital. Nadapuram, Kozhikode provided the completion certificate.
The Prosecution status: Prosecution sanctions for A1.Shri. Dr.Lalu Jones.R. (Superintendent, Taluk Government Hospital Nadapuram, Kozhikode) and A2, Shri.K. Faizal. (Assistant Engineer, Irrigation South Section, Civil Station, Kozhikode) were obtained. Since A3, A4 and A5 are private persons prosecution sanction is not needed. The charge sheet under preparation and will be submitted before the Hon'ble court before the 20th of December 2025.”
4. On perusal of the report, it is discernible that the investigation has been completed, the charge sheet is under preparation and the same would be filed before 20.12.2025 on getting the prosecution sanction.
5. In view of the above development, this petition is disposed of directing the Investigating Officer to file the final report, as reported, on or before 20.12.2025.
6. It is made clear that if the petitioner is aggrieved by the final report, he is at liberty to resist the same in the manner known to law.
This criminal miscellaneous case is disposed of as indicated above.
