1. This Writ Petition is filed seeking a Writ of Mandamus declaring the order of the 3rd respondent in Cr.No.A2/269/2025, dated 11.08.2026 in rejecting the petitioner’s objection to the proposed shifting of A4 Shop No.2 from Maddur Village and Mandal to Vallampatla Village, Maddur Mandal, Siddipet District, as illegal, arbitrary and contrary to Rule 28 of the Telangana Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2012, and consequently direct the official respondents not to permit such shifting and to pass such other order or orders as this Hon’ble Court may deems fit and proper.
2. Heard Mr.Jalli Kanakaiah, learned Senior Counsel representing Mr.Narendar Jalli, learned counsel for the petitioner, learned Government Pleader for Prohibition and Excise appearing for respondent Nos.1 to 4 and Mr.C.Raghu, learned counsel, representing Ms.Chinnaboina Sravani, learned counsel for respondent No.5.
3. The brief facts of the case are that the 2nd respondent, vide Proceedings No.1686/2025/CPE/F1/1, dated 24.09.2025, permitted relocation of certain A4 liquor shops based on their viability. Pursuant thereto, the shop at Kootigal Village, Doolimitta Mandal, Siddipet District, was shifted to Duddeda Village, Kondapaka Mandal.
4. Thereafter, vide Notification No.88/2025, dated 26.09.2025, the Government notified the A4 shops in Siddipet District. The petitioner was allotted the A4 shop at Doolimitta Village, while the unofficial respondent was allotted Shop No.2 at Maddur Village through lottery.
5. The unofficial respondent thereafter sought shifting of Shop No.2 from Maddur to Vallampatla Village. The petitioner objected to the proposed shifting, contending that it would adversely affect the petitioner’s business, as Vallampatla is situated close to the villages falling within the petitioner’s business area. The petitioner’s objection was referred to the Prohibition and Excise authorities, who recommended the proposed shifting. The petitioner submits that he has invested substantial amounts towards licence/rent and would suffer serious financial loss if the shifting is permitted. Hence, the present writ petition.
6. Learned Senior Counsel for the petitioner submits that Rule 28 of the Telangana Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2012, permits shifting of licensed premises only for valid reasons and subject to the conditions prescribed therein. He further submits that the proposed shifting is contrary to the said Rule and would adversely affect petitioner’s existing business.
7. The issue involved in the present Writ Petition relates to the shifting of A4 Shop No.2 from Maddur Village and Mandal to Vallampatla Village, Maddur Mandal, Siddipet District.
8. Earlier, the petitioner filed a Writ Petition No.38664 of 2025 seeking a direction to the authorities to consider and dispose of his representation raising objections to the proposed shifting of the aforesaid shop. This Court directed the authorities to consider and dispose of the said representation. Pursuant thereto, the Office of the District Prohibition and Excise Officer, Siddipet, passed an order in Cr.No.A2/269/2022, dated 11.08.2026. The operative portion of the said order reads as follows:
“Further, it is to inform that during the Licence year 2021-23 and 2023-25 there were (2) A4 Shops established in Maddur (V&M). The population of Maddur (V) is (3221) which limits sales potentiality. Hence, it is proposed to shift one A4 shop (G.SI.No.SDP079) to Vallampatla (V), Maddur (M), as the Vallampatla village is located in Maddur Mandal and Dhoolmitta is in separate Mandal Head Quarters. Vallampatla to Dhoolmitta distance is about (7) KMs. The proposed shifting location is within the Mandal of Maddur. Therefore, the shifting of A4 Shop from Maddur to Vallampatla Village does not affect the sales of Dhoolmitta A4 Shop. However, the Commissioner of Proh.& Excise, Telangana, Hyderabad is competent authority to accord permission for shifting of A4 Shop.
In view of the above circumstances explained and report of the Proh.& Excisse Inspector of S.H.O. Cherial, Sri B.Sravan Kumar Licensee of Sri Renuka Yellamma Wines, Dhoolmitta (V&M) G.SI.No.SDP080 is informed that the objection has no valid grounds. Accordingly, the representation dt:11.12.2025 is considered and disposed of on the above lines.”
9. The aforesaid order is impugned in the present Writ Petition.
10. At this juncture, learned Senior Counsel appearing for the petitioner submitted that the objections raised by the petitioner were rejected without assigning proper reasons and without duly considering the grounds urged therein. It is further submitted that the order dated 11.08.2026 is not a final order, as respondent No.2 is the competent authority to pass the final order with regard to the proposed shifting of the A4 Shop. Therefore, he sought liberty to the petitioner to file his objections before respondent No.2.
11. Learned Government Pleader for Prohibition and Excise appearing for respondent Nos.1 to 4 and learned counsel for respondent No.5 did not oppose the said submission made by learned Senior Counsel for the petitioner.
12. Having regard to the said submissions, the petitioner is granted liberty to submit his objections before the respondent No.2 within a period of one (1) week from the date of receipt of a copy of this order. Upon receipt of such objections, the respondent No.2 shall consider the objections of the petitioner, as well as the order dated 11.08.2026 and pass appropriate orders, by assigning valid reasons, in accordance with law, within a period of two (2) weeks thereof.
13. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
