Head Note :-
Subject
Judgment :-

1. Mr. Rajagopallavan Tayi, learned counsel appears for the petitioner.

Mr. T. Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences, appears for respondent No.2.

2. With the consent of learned counsel for the parties, the Writ Petition is heard finally.

3. This Writ Petition is filed for the following relief:

“... to issue an appropriate writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondent No.2 in not extending time for reporting the 3rd respondent college, even though the petitioner was allotted seat under Management quota (MQ) is illegal, arbitrary, and unconstitutional and violative of Article 14, 21A of the Constitution of India and consequently direct the respondent No.2 to extend time and permit the petitioner to pay requisite fees and complete formalities forthwith for admission into MBBS/BDS course under management quota B-Category in 3rd respondent college or in alternative direct the respondent No.2 to allow the petitioner to participate and exercise web option in the second phase of counselling for admission into MBBS/BDS course for the academic year 2026-27 and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

4. Learned counsel for the petitioner submits that the petitioner was allotted MBBS seat under Management Quota for the academic year 2026-27 in respondent No.3-College in the first phase of counselling and she had to pay the requisite fee on or before 21.09.2026. However, as the petitioner could not mobilise the amount, she could not deposit the requisite amount within the time stipulated. The petitioner has now mobilised the amount. However, respondent No.3-College did not accept the same.

5. Learned counsel for the petitioner has referred to order dated 29.11.2022 passed by a Division Bench of this Court in W.P.No.43034 of 2022, wherein, in similar circumstances, the Division Bench of this Court had disposed of the Writ Petition directing the petitioner therein to go and report before respondent No.4-College therein before 05:00 PM on 30.11.2022 and pay necessary fee and upon such reporting before respondent No.4 therein, it shall permit the petitioner therein to join in MBBS course and pursue the said course in accordance with law.

6. It appears from a perusal of the said order that the said directions were issued upon specific submission of the learned Standing Counsel for respondent No.2-University that though the last date for admission i.e., 17.11.2022 was over, since the seat is not allotted to any other student, the petitioner may report before respondent No.4 therein on or before 30.11.2022 without fail and then the respondents therein would consider the case of the petitioner for admission into MBBS course.

7. Learned counsel for the petitioner has also relied upon another common order dated 23.11.2022 passed by a Division Bench of this Court in W.P.Nos.42529 and 42384 of 2022. It appears that similar directions were passed therein based upon the submission of the learned Standing Counsel for respondent No.2-University to allow the petitioners therein to report before the respondent-College therein on or before 24.11.2022, though the last date to report had expired on 17.11.2022, as the petitioners therein were suffering from COVID infection. In the order dated 18.11.2025 passed by this Court in W.P.No.34937 of 2025, on which the petitioner also seeks reliance, it is seen that the learned Standing Counsel for respondent No.2-University, on instructions, submitted that in exceptional circumstances i.e., ill-health, the representation of the petitioner therein to participate in the counselling process for the stray vacancies, which was going on that day, would be considered by respondent No.2-University.

8. The aforesaid decisions do not lay down any proposition of law as they are rendered on the basis of the stand of learned Standing Counsel for respondent No.2-University.

9. In the present case, the last date to deposit the amount for admission to MBBS course was till 21.09.2026, by which date, the petitioner could not make the deposit. There is no challenge to the cut-off date in the present Writ Petition.

10. Learned counsel for the petitioner submits that the petitioner has made a representation before respondent No.2-University on 22.09.2026, to allow her to complete the payment and admission requirements, but the same has not yet been considered. He further submitted that respondent No.2-University be directed to decide the said representation sympathetically in a time bound manner.

11. Learned Standing Counsel for respondent No.2-University submitted that the petitioner’s representation shall be dealt with by respondent No.2-University in accordance with law.

12. Accordingly, the instant Writ Petition is disposed of directing respondent No.2-University to decide the petitioner’s representation dated 22.09.2026 sympathetically, as per the grounds taken in it and in accordance with law, by passing a reasoned order within a period of two days. It is made clear that this Court has not expressed any opinion on the merits of the case. There shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
