(Prayer: Petition under Article 227 of The Constitution of India praying against the fair and decretal order dated 30.3.2026 made in I.A.No.6 of 2024 in O.S.No.53 of 2012 on the file of the District Munsif Court at Sriperumbudur.)
1. This civil revision petition has been filed under Article 227 of The Constitution of India against the order dated 30.3.2026 made in I.A.No.6 of 2024 in O.S.No.53 of 2012 on the file of the District Munsif Court at Sriperumbudur.
2. Heard the learned counsel for the petitioner and the learned counsel appearing for the second respondent.
3. This Court has carefully considered the submissions of the learned counsel on either side and perused the materials available on record and more particularly the impugned order.
4. The petitioner, who is the plaintiff, filed the said suit seeking for the relief of declaration to declare the sale deed dated 14.8.1996 executed by the first defendant/first respondent in favour of the second defendant/second respondent as null and void, for a direction to the first respondent/first defendant to execute a registered sale deed and convey the suit property in favour of the petitioner/plaintiff, for permanent injunction restraining the respondents/defendants from in any manner interfering with the peaceful possession and enjoyment of the suit property by the petitioner/plaintiff and also restraining the second respondent/ second defendant from in any manner encumbering or alienating the suit property.
5. The case was at the stage of trial. At that stage, the respondents/defendants filed I.A.No.3 of 2023 under Order VIII Rule 3(a) of the Civil Procedure Code (CPC) seeking to receive certain additional documents. The said application came to be allowed by the Court below vide order dated 21.12.2024. Later, the petitioner/ plaintiff filed I.A.No.5 of 2024 under Order VII Rule 14(3) of the CPC for filing additional documents and it was also allowed by the Court below by order dated 07.2.2026.
6. Again, the petitioner/plaintiff filed I.A.No.6 of 2024 seeking to amend the plaint to incorporate necessary averments and also to declare the revenue records like patta, chitta and adangal as null and void and vitiated by fraud. This application came to be dismissed by the Court below by the impugned order. Aggrieved by that, the above civil revision petition has been filed before this Court.
7. In the considered view of this Court, the revenue records that are relied upon by the respondents/defendants will not have any bearing while deciding the said suit since the petitioner/plaintiff is questioning the very sale deed that has been executed by the first respondent/first defendant in favour of the second respondent/ second defendant. The evidentiary value of the revenue records relied upon by the respondents/defendants will be considered by the Court below in the process of appreciation of evidence. It is not necessary for the petitioner/plaintiff to seek for declaring all those revenue records as null and void. In fact, such an amendment is unnecessary since the very title over the suit property has been put to question.
8. The Court below was right in dismissing I.A.No.6 of 2024 after finding that the interest of the petitioner/plaintiff has been safeguarded sufficiently while passing the order dated 21.12.2024 in I.A.No.3 of 2023 and there is no need for amending the pleadings.
9. One of the grievances that was expressed by the learned counsel for the petitioner/plaintiff is that the documents that were filed as additional documents have now been marked before the Court below and that the Court below should not act upon the same.
10. It is trite law that mere marking of documents will not tantamount to proof of all those documents. Their evidentiary value will be independently considered by the Court below while dealing with the merits of the case.
11. Useful reference can be made to the latest decision of the Hon’ble Apex Court in S.Sangeetha Vs. P.Ponni [reported in 2026 (5) MLJ 3].
12. For the foregoing reasons, the above civil revision petition is dismissed and the impugned order dated 30.3.2026 made in I.A.No.6 of 2024 in O.S.No.53 of 2012 on the file of the District Munsif Court at Sriperumbudur is sustained. There shall be a direction to the District Munsif Court, Sriperumbudur to dispose of the said suit within a period of three months from the date of receipt of a copy of this order. It is made clear that the order passed in this civil revision petition will not have any bearing while hearing the said suit on merits. No costs. Consequently, the connected CMPs are also dismissed.
