1. Affidavit-of-service, filed in Court today, is taken on record.
2. Dr. Arjun Chowdhury, learned Advocate appears for the petitioner.
3. Mr. Kunaljit Bhattacharjee, learned Additional Government Pleader appears for the State.
4. Mr. Bikramaditya Ghosh, learned Advocate appears for the respondent no.2.
5. The writ petitioner college submits that, the students who are mentioned in paragraph 8 of the writ petition have not yet received the registration for the D.El.Ed. course and the examination will take place on September 2, 2026 as notified.
6. In view of the above, the petitioner shall serve a copy of the writ petition along with a copy of today’s order upon the Secretary, West Bengal Board of Primary Education forthwith.
7. The Secretary of the Board then after granting the petitioner an opportunity of hearing shall hold the hearing on August 27, 2026 at 12.00 Noon onwards at his office and shall pass the reasoned order which shall be collected by the college from the office of the Secretary on August 28, 2026 and the office of the Secretary shall also be at liberty to inform the college over its recorded e-mail.
8. In the event, registration is granted to such students or such number of students out of them, they shall be eligible for appearing in the forthcoming examination after compliance of all necessary formalities in accordance with law.
9. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.
10. With the above observations and directions the writ petition, WPA 1845 of 2026 stands disposed of, without any order as to costs.
11. Parties shall act on the server copy of this order duly obtained from the official website of this Court.
12. Photostat certified of this order, if applied for, be furnished expeditiously.
