Judgment :-

(Prayer: This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a writ of certiorari setting aside the communication /order Vbearing No. Blr.Fed.Ceif. No. S775/22-15-002/2023-2024 dated 28-07-2023 addressed by the Respondent No. 4 (Annexure A) returning the compounding application dated 22.02.2023 filed by petitioner seeking Respondent No, 4 to allow it to compound the alleged Contraventions under Foreign Exchange Management Act (FEMA) 1999 and etc.)

Oral Order

1. The petitioner is before this Court seeking for the following reliefs:

          A. To issue a Writ of Certiorari setting aside the communication/Order bearing no. BLR.FED.CEIF. No. S775/22-15-002/2023-2024 dated 28.07.2023 addressed by the Respondent No.4 (Annexure A) returning the Compounding application dated 22.02.2023 filed by Petitioner seeking Respondent No.4 to allow it to compound the alleged contraventions under Foreign Exchange Management Act (FEMA) 1999.

          B. To issue a Writ of Mandamus directing the Respondents to reconsider the compounding application dated 22.02.2023 (Annexure A) seeking to compound the alleged contraventions under FEMA 1999, Foreign Exchange Management (Transfer or issue of Security by a person resident outside India) Regulations, 2000 in accordance with law.

          C. To issue a Writ of Mandamus directing the Respondents to adjudicate the Complaint bearing No. T-3/CEZO/Z-II/112/2018 and any other contraventions reported by the Petitioner in their Compounding application dated 22.02.2023 to the Respondents in accordance with law.

          D. To issue any other Writ/directions as this Hon'ble Court deems fit or appropriate under the above circumstances in the interest of justice and equity.

2. A memo has been filed by the learned counsel for the petitioner seeking withdrawal of the petition, which reads as under:-

          MEMO FOR WITHDRAWAL

          "The counsel appearing for the Petitioner herein prays this Hon'ble Court to permit the Petitioner to withdraw the above-mentioned Writ Petition and further be pleased to pass the necessary orders reserving liberty to Petitioner to exercise its rights available under the law in the interest of justice and equity."

3. Accepting the memo and the submission made by the learned counsel for the petitioner, the Writ Petition stands dismissed as withdrawn.
