Oral Order
1. Accused No.5 in SC No.631/2023 pending before the Court of LVII Additional City Civil and Sessions Judge, (CCH-58), Mayo Hall Unit, Bengaluru, arising out of Crime No.290/2017 registered by HAL Police Station, Bengaluru, for the offences punishable under Sections 399 and 402 of the IPC, 1860, is before this Court in this petition filed under Section 483 of BNSS, 2023, is before this Court seeking regular bail.
2. Heard the learned counsel for the parties.

A perusal of the material on record would go to show that the petitioner, who was arrested in the present case was earlier granted bail by the jurisdictional Sessions Court in SC No.1451/2017 vide order dated 24.01.2020. It appears that, subsequently, the petitioner had not appeared before the Trial Court in SC No.1451/2017. Therefore, a split-up case was registered against the petitioner in SC No.631/2023 and in the said proceedings, coercive steps were taken against him and his presence was secured and now remanded to judicial custody on 15.06.2026. His bail application filed before the Sessions Court in SC No.631/2023 was rejected on 04.07.2026. Therefore, he is before this Court.

Learned counsel for the petitioner has brought to the notice of this Court that accused Nos.1 to 4 in the present case as against whom similar allegations are found in the charge sheet, were tried for the charge sheeted offences in SC No.1451/2017 and they have been acquitted by the Sessions Court by judgment and order of acquittal dated 04.02.2025.

The fact remains that the petitioner was earlier granted regular bail in the present case on merits by the Sessions Court in SC No.1415/2017 and only for the reason that, he had not appeared before the Sessions Court, he has now been arrested and remanded to judicial custody on 15.06.2026. In all the other cases registered against the petitioner he has been acquitted.
6. It is brought to the notice of this Court by the learned counsel for the petitioner that after the year 2023, the petitioner has not involved himself in any other offences.
7. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER
The criminal petition is allowed. The petitioner is directed to be enlarged on bail in SC No.631/2023 pending before the Court of LVII Additional City Civil and Sessions Judge, (CCH- 58), Mayo Hall Unit, Bengaluru, arising out of Crime No.290/2017 registered by HAL Police Station, Bengaluru, for the offences punishable under Sections 399 and 402 of the IPC, 1860, subject to the following conditions:
a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future.
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
