Common Order
1. These two Criminal Petitions are heard together and are being disposed of by this common order, as the crimes registered against the Petitioner are different, but the Petitioner in both the petitions is one and the same.
2. The Criminal Petition No.6589 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.306 of 2026 of Tirupati East Police Station, Tirupati District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 144(2), 111(1) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) and Sections 3(2)(a), 4(1), 5(1)(a) of the Immoral Traffic (Prevention) Act, 1956 (for brevity ‘the ITP Act’).

The Criminal Petition No.6590 of 2026 has been filed under Sections 480 and 483 of ‘the BNSS’ seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.432 of 2025 of Tiruchanur Police Station, Tirupati District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 143(3), 144(2) read with 3(5) of ‘the BNS’ and Sections 3(1), 4(1), 5(1)(a),7(1)(a) of ‘the ITP Act’.
4. Sri D.Purna Chandra Reddy, the learned counsel for the petitioner, submits that the petitioner is innocent of the alleged offences and she has been falsely implicated by the police. The petitioner is a female and aged about 36 years. She is a law-abiding citizen. The petitioner undertakes to strictly adhere to any conditions that may be imposed by this Court. In light of the foregoing submissions, learned counsel prays that the present petitions be allowed in the interest of justice.

Per contra, Mr.A.Sai Rohith, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is further submitted that if the petitioner is released on bail at this stage, there is a strong likelihood that she may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged that the petitions be dismissed.
6. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
7. As seen from the record, the Petitioner is arraigned as Accused No.1 in Crime No.306 of 2026 of Tirupati East Police Station and Crime No.432 of 2025 of Tiruchanur Police Station. Pursuant to the registration of Crime No.306 of 2026, the Petitioner voluntarily surrendered before the learned jurisdictional Magistrate concerned on 18.06.2026. Thus, she has been in judicial custody for the past 53 days. Subsequently, a P.T. Warrant was issued and executed, pursuant to which the Petitioner was arrested in Crime No.432 of 2025 of Tiruchanur Police Station. So far, six witnesses have been examined in the two crimes. The material portion of the investigation has been completed. The allegation against the Petitioner, a female aged about 36 years, is that she was running a brothel in the limits of Tirupati East Police Station and Tiruchanur Police Station.
8. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail with some stringent conditions.
9. In the result, these two Criminal Petitions are allowed with the following stringent conditions:
i. The Petitioner/Accused No.1 shall be enlarged on bail subject to her executing a bond for a sum of Rs.50,000/-(Rupees Fifty Thousand only) with two sureties for the like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Tirupati.
ii. The Petitioner/Accused No.1 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet.
iii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned.
iv. The Petitioner/Accused No.1 shall not commit or indulge in the commission of any offence while she is on bail. If it is reported that she has indulged in the commission of a similar offence, the bail granted to her shall stand cancelled automatically. The Station House Officer, Tirupati East Police Station, and the Station House Officer, Tiruchanur Police Station, are at liberty to arrest the Petitioner and produce her before the jurisdictional Magistrate for remand to judicial custody.
v. The Petitioner/Accused No.1 shall cooperate with the investigating officer in further investigation of the case and shall make herself available for interrogation by the Investigating Officer as and when required.
vi. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court.
