1. Challenging the action of the action of the respondent No.4 in granting permission to respondent No.8, in his individual capacity, to conduct a procession during URS-E-Shareef at Dargah Hazrath Syed Imam Ali Shah Al-Hussaini Al-Qadri (R.A.), situated at Roshan-ud-Daula, Balapur, Ranga Reddy District, despite the earlier rejection of respondent No.8's request for police bandobust for a similar purpose and despite there being existence of the petitioner-Towliat Committee for the said Dargah which has also been granted permission, as illegal and arbitrary, this writ petition has been filed.

2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home appearing for respondents 1 to 5, Sri Farhan Azam Khan, learned Standing Counsel for the Wakf Board, appearing for respondents 6 and 7, and Sri L. Ram Singh, learned counsel appearing for respondent No.8.

3. The writ petitioner is the Towliat Committee appointed by the Wakf Board for the general administration of the Dargah. It is submitted that the petitioner-Committee sought permission to conduct the annual URS from 09.08.2026 to 13.08.2026, and the Assistant Commissioner of Police, Chandrayangutta-respondent No.4, granted permission on 31.07.2026 subject to certain conditions. It is further submitted that respondent No.8 also made an application seeking permission to conduct URS-E-Shareef in his capacity as a direct descendant of the saint, and respondent No.4 granted him permission vide Permission No.1473/OW/ACP-CGT/2026, dated 31.07.2026, to conduct the URS on 10.07.2026 from 6:00 p.m. to 10:00 p.m. for a gathering of 500 to 1,000 persons.

4. Learned counsel for the petitioner submitted that the date of 10.07.2026 mentioned in the permission order is erroneous and ought to be read as 10.08.2026. It is contended that respondent No.4 has granted permissions to both the petitioner-Committee as well as to respondent No.8, in his individual capacity, for conducting the URS on the same day which is not in accordance with law and the procedure adopted earlier. It is further submitted that the petitioner-Committee, being in charge of the administration of the Dargah, alone is entitled to conduct the URS, while respondent No.8, as a direct descendant of the saint and as a devotee may participate in the procession and rituals. It is further submitted that on an earlier occasion, respondent No.4 rejected respondent No.8's application by proceedings dated 02.04.2026, observing that only the Committee was entitled to conduct the URS and that no individual should be permitted to disturb public peace and tranquility and in direct conflict with the same, permission has since been granted. He therefore seeks a direction to set aside the same.

5. Learned counsel appearing for respondent No.8 submitted that, aggrieved by the order of rejection dated 02.04.2026, respondent No.8 had filed W.P. No.10114 of 2026, and this Court, by order dated 02.04.2026, directed the authorities to permit the petitioner therein to participate in the URS-E-Shareef procession scheduled on 06.04.2026 from 6:00 p.m. to 10:00 p.m. and to provide necessary police bandobust to ensure maintenance of law and order. It is submitted that, pursuant to the said order, respondent No.8 was granted permission by respondent No.4 vide proceedings dated 31.07.2026. However, this Court finds that the permission granted to respondent No.8 does not make any reference to the earlier order of this Court.

The learned Assistant Government Pleader for Home, on the basis of written instructions, submitted that permission was granted to the petitioner-Committee as it is the Committee appointed by the Wakf Board. It is further submitted that permission was also granted to respondent No.8 in view of the orders passed by this Court, subject to the conditions imposed by the authorities.

7. This Court finds that permitting both parties to conduct the URS on the same day and during the same time is likely to create law and order issues. It is seen that, on the earlier occasion, this Court recognized the right of the Towliat Committee to conduct the URS while permitting respondent No.8 to participate in the rituals, with a direction to the police authorities to ensure maintenance of law and order. However, it appears that disturbances occurred, resulting in the registration of FIR No.47 of 2025, dated 18.04.2025.

8. Learned counsel for respondent No.8 submitted that this Court, by order dated 24.07.2026 passed in Crl.P. No.11791 of 2026, quashed the cognizance order and directed the learned Magistrate to consider the matter afresh and proceed in accordance with law.

9. The learned Standing Counsel for the Wakf Board submitted that it is the Towliat Committee, appointed by the Wakf Board, which is authorized to perform the functions relating to the Dargah. It is further submitted that respondent No.8 has challenged the constitution of the Committee, and the said proceedings are presently pending consideration before the Tribunal. He submitted that respondent No.8, being the direct decendent of the saint also can perform the rituals.

10. Having regard to the rival contentions and the material on record, this Court finds that it is not in dispute that the URS can be conducted throughout the day. While the petitioner-Committee asserts that it alone is entitled to conduct the URS, respondent No.8 claims that, being a direct descendant of the saint, he is also entitled to perform the rituals. In order to balance the competing claims and to ensure maintenance of public peace and harmony, this Court directs that the petitioner-Committee shall conduct the URS and perform the rituals on 10.08.2026 until 8:00 p.m. and thereafter, respondent No.8 shall be permitted to perform the rituals. All parties shall maintain peace and communal harmony, and the respondent-police shall take all necessary steps to maintain law and order during the conduct of the URS.

11. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
