Learned advocate for the appellant submits that appellant has submitted a proposal to the SEBI. He prays that this appeal may be disposed of recording his submission with a direction to the SEBI to examine the proposal.

2. Mr. Sumit Rai, learned advocate for the respondent- SEBI, on instructions, submitted that SEBI shall consider the proposal on merits and the question of maintainability raised by the SEBI may be kept open in the event the appellant approaches this Tribunal again. His submission is fair and accepted. Accordingly, this appeal stands disposed of by placing the submission of learned advocate for the appellant mentioned above. The question of maintainability is kept open.
