Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased leased to direct Respondents to consider the representation dated 26.06.2026 of the petitioner and accord permission, together with necessary police protection, for conducting the religious, customary and cultural programmes of the Sri Sri Sri Maremma Mavulamma Ammavarla Jatara Mahotsavam from 12.07.2026 to 14.07.2026 at Achanta Vemavaram, Achanta Mandal, West Godavari District, subject to such reasonable conditions as this Hon’ble Court may deem fit to impose, including those laid down by this Hon’ble Court in Maremma Poleramma Varla Jathara Utsava Committee, Kavitam v. State of Andhra / Pradesh (2020) 2 ALT 295 pending disposal of the above writ petition and to pass)
1. Instant Writ Petition has been under Article 226 of the Constitution of India for the following relief:
“.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declaring the action of the 3rd respondent and his police personnel in calling the petitioners to the police station and visiting the petitioners house and interfering with their personal life and liberty, without following the due process of law as illegal, violative of Articles 14 and 21 of the Constitution of India and contrary to the provisions of the BNS and consequently direct the 3rd respondent not to harass the petitioners by calling them to the police station and pass such other order or orders …”.
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned counsel for the petitioner submits that Sri Sri Sri Maremma Mavulamma Ammavarla Jatara Mahotsavam is going to be celebrated from 12.07.2026 to 14.07.2026 at Achanta Vemavaram, Achanta Mandal, West Godavari District and in that process, petitioner preferred a representation dated 26.06.2026 before the respondent police authorities, seeking necessary permission. Till today, the said representation is pending, as such, the present Writ Petition is filed seeking disposal of the same.
4. Learned Assistant Government Pleader for Home basing on the Written Instructions dated 07.07.2026 of the Sub-Inspector of Police, Achanta Police Station, West Godavari District submits that respondent police have no objection to accord permission with certain conditions.
5. Learned counsel for the petitioner submits that in view of the religious programme, respondent police could not impose conditions unilaterally.

In the light of the above facts and circumstances, respondent-police are directed to consider the petitioner’s representation dated 26.06.2026 and accord permission and provide necessary police protection for the cultural and other programmes that are being conducted during the Sri Sri Sri Maremma Mavulamma Ammavarla Jatara Mahotsavam at Achanta Vemavaram, Achanta Mandal, West Godavari District from 12.07.2026 to 14.07.2026 on the following conditions:
i) Petitioner shall take all stringent and necessary steps so that no obscene dances or vulgar programmes are being staged and performed during the course of Utsavam.
ii) Respondent police shall take steps to video-graph the programmes at the expense of the petitioner and if he finds any obscene programmes are conducted, he can submit a report to the Court for taking action against the concerned persons for contempt of the Court Order.
iii) No dance or songs, touching upon any political party or religion or community or caste shall be played.
iv) No flex boards in support of any political party or communal leader, shall be erected at the premises of the programme.
v) If there is violation of anyone of the conditions imposed, the concerned police officer is at liberty to take necessary action, as per law and stop such performance forthwith; and
vi) Petitioner shall furnish a letter of undertaking to the respondents that they will strictly adhere to the above conditions.
7. Accordingly, the Writ Petition is disposed of. No order as to costs.
8. Learned Assistant Government Pleader for Home is directed to communicate the gist of this Order to the concerned police authorities, for effective implementation.
Interlocutory applications, if any, pending shall stand closed.
