Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the 1st Respondent to take an expeditious decision on the proposal submitted by the Petitioner Institution and recommended by the 2nd Respondent for grant of NOC/Permission to commence Diploma in Computer Science and Engineering (60 Seats) and Diploma in Electronics and Communication Engineering (60 Seats) for the Academic Year 2026-27 and, pending such decision, direct the Respondents to permit the Petitioner Institution to participate in the Polytechnic Admissions Counselling/Web-Based Admission Process for the Academic Year 2026-27 by provisionally including the aforesaid courses approved by AlCTE, so as to safeguard the interests of the Institution and prospective students, and pass such)
1. Heard Sri Vijay Mathukumilli, learned counsel for the petitioner and the learned Assistant Government Pleader for Higher Education appearing for the respondents.

The grievance of the petitioner in the instant Writ Petition is against the action of the respondents in not granting NOC/permission for commencement of the technical courses, viz., Diploma in Computer Science and Engineering and Diploma in Electronics and Communication Engineering, for the academic year 2026-27, despite the approval granted by the All India Council for Technical Education (AICTE) vide proceedings F.No.South-Central/1-46228063600/2026/EOA/Corrigendum-1 dated 14.05.2026.

It is contended that the petitioner Institution has sought permission from the All India Council for Technical Education (herein after referred as ‘AICTE’) for commencement of two additional Diploma Courses namely a) Diploma in Computer Science and Engineering – Intake of 60 seats; and b) Diploma in Electronics and Communication Engineering – Intake of 60 seats. In the said regard, the applications were submitted by the petitioner to the respondents as well as to the AICTE.
4. It is contended that the said applications was presented on 13.12.2025 and were received by the respondents on 15.12.2025. On the basis of the said application, the AICTE has separately conducted inspection and granted NOC. The respondent authorities also conducted an inspection on 27.02.2026, during which no deficiencies were noted by the authorities. It is contended that in respect of the said courses for the academic year 2026-27, the counseling is to be held on 24.06.2026. Thus the learned counsel for the petitioner contends that any delay in considering the petitioner’s application would cause severe hardship to the Institution. Having regard to the schedule fixed by the respondents for admissions and counseling, it is incumbent upon them to complete inspection, verification and grant required permissions well before the counseling commences. However, the pendency of the application not only deprives the petitioner Institution, but also the students. Thus it is argued that the respondents must act swiftly upon the petitioner's applications without any further delay.

When the matter has been taken up for consideration today, the learned Assistant Government Pleader appearing for the respondent No.1 has placed before the Court a copy of instructions received by him in the case. A perusal of the same would reflect that the proposal relating to the petitioner Institution for commencement of the aforesaid Diploma courses is currently pending with the Government and that necessary orders would be issued upon completion of the process in accordance with law and the relevant guidelines.

Having regard to the same, as the AICTE has granted approval for commencement of the subject courses(new) and as the respondents herein have already conducted inspection and verification and did not find any shortcoming, this Court deems it appropriate to dispose of the Writ Petition directing the respondent No.1 to pass appropriate orders on the application filed by the petitioner seeking permission for commencement of new courses namely a) Diploma in Computer Science and Engineering and b) Diploma in Electronics and Communication Engineering. Pending consideration of the said proceedings as it is stated by the learned counsel for the petitioner that the counseling would be commenced on 24.06.2026, this Court deems it appropriate to direct the respondents to allow the petitioner to participate in the counseling process in respect of the additional courses viz., a) Diploma in Computer Science and Engineering and b) Diploma in Electronics and Communication Engineering, that is scheduled on 24.06.2026 and allow intake of the students.

Needless to observe that the said intake of students to the said courses(new),would be subject to the proceedings of the respondent No.1 that would be passed on the application filed by the petitioner seeking permission/no objection for commencement of the subject courses i.e., a) Diploma in Computer Science and Engineering and b) Diploma in Electronics and Communication Engineering.
8. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, all pending miscellaneous applications shall stand closed.
