Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay the pending admitted bills for the work supply of neem organic manure to the ITDA Parvathipuram 3rd respondent for an amount due of Rs 8,39,437/- as per award in CASE No. 21C/IFC/2018/3377 dated 28.01.2020 in favor of the petitioner even though supplied the materials pending disposal of the above writ petition and pass)
1. Heard both sides. Perused the record.
2. Learned Government Pleader for Finance would submit that they are not concerned to this matter regarding payment and it has to be done by the Project Officer, ITDA, Parvathipuram.
3. On the instructions, learned Government Pleader for Social Welfare would submit that the petition may be disposed of by giving four (4) weeks time to the respondent No.3 to clear the due amount.
4. Having regard to the submissions made by the learned Government Pleader for Social Welfare, it is apposite to dispose of the present Writ Petition, since there is no dispute regarding payment due to the Writ Petitioner.
5. Accordingly, the present Writ Petition is disposed off directing the Respondent No.3/Project Officer, ITDA, Parvathipuram to take necessary steps for payment of due amount to the Writ Petitioner i.e., Rs.8,39,437/-, within a period of four (4) weeks from this date.
Interim orders granted earlier if any, stand vacated. Miscellaneous petitions pending if any, stand closed.
