Judgment :-

1. The petitioners have filed the present writ petition calling in question the legality, validity and propriety of the order dated 18.05.2026 (Annexure P/1) passed by the Upper Collector, Raipur, District Raipur, whereby the revision preferred by the petitioners against the order dated 02.04.2026 (Annexure P/2) passed by the Sub Divisional Officer (Revenue), Abhanpur, District Raipur, has been rejected. The petitioners have prayed for following relief(s):-

          "(i) That, this Hon'ble Court may kindly be pleased to set-aside the impugned order dated 18.05.2026 (annexure P-1) passed by the Upper Collector Raipur District Raipur, order dated 02.04.2026 (annexure P-2) passed by the learned Sub Divisional Officer (Rev) Abhanpur, District Raipur, in the interest of justice.

          (ii) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to delete the blocked lands of the petitioners by the criminal nature, at the earliest, in the interest of justice.

          (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted."

Learned counsel for the petitioners submits that the petitioners are recorded bhoomiswamis of the land bearing Khasra Nos. 27/3, 33/1, 33/2, 33/3, 33/4, 33/6, 36/2, 36/3 and 36/4 situated at Village Kendri, P.H. No.16, Tahsil Abhanpur, District Raipur. It is submitted that respondent No.1 lodged a complaint before the Commissioner of Police, Raipur alleging embezzlement of certain amounts by the petitioners. According to learned counsel, the dispute raised in the complaint is essentially criminal in nature. It is further submitted that on the basis of the said complaint, the Sub Divisional Officer (Revenue), Abhanpur registered a revenue case and vide order dated 02.04.2026 called for a report from the concerned Patwari. Learned counsel submits that during the pendency of the proceedings, the names of the petitioners appearing in the online revenue portal in respect of the aforesaid lands have been shown as blocked, thereby adversely affecting the rights of the petitioners over the subject lands. He further submits that aggrieved by the order dated 02.04.2026, the petitioners preferred a revision before the Upper Collector, Raipur, which has also been dismissed by the impugned order dated 18.05.2026 without properly considering the material available on record and without addressing the grievance of the petitioners regarding blocking of their lands in the online revenue records.

On the other hand, learned State counsel submits that the proceedings before the revenue authorities are still pending and the petitioners have an efficacious remedy to raise all their objections before the competent revenue authority. It is submitted that appropriate orders can be passed by the competent authority after considering the facts and circumstances of the case and after granting opportunity of hearing to all concerned parties.

4. I have heard learned counsel for the parties and perused the material available on record.

Upon perusal of the material available on record, this Court is of the view that the grievance raised by the petitioners pertains to the action taken by the revenue authorities pursuant to the proceedings initiated on the complaint made by respondent No.1 and the consequential blocking of the petitioners' names/lands in the online revenue records. The issues raised involve factual aspects which can appropriately be examined by the competent revenue authority.

Considering the aforesaid aspect of the matter, the petitioners are directed to file an appropriate application/representation before the concerned Sub Divisional Officer (Revenue), Abhanpur, District Raipur, along with all relevant documents in support of their claim, within a period of 10 days from the date of receipt of a certified copy of this order.

7. In the event such an application is filed, the concerned Sub Divisional Officer (Revenue) shall consider and decide the same expeditiously in accordance with law. The Sub Divisional Officer shall take into consideration the grievance raised by the petitioners regarding blocking of the subject lands in the online revenue records and shall pass appropriate orders after affording due and effective opportunity of hearing to the petitioners as well as all other affected parties. It is further directed that if any order is required to be passed in the revenue proceedings initiated on the complaint made by respondent No.1, the concerned Sub Divisional Officer (Revenue) shall ensure that adequate opportunity of hearing is granted to the petitioners and thereafter pass a reasoned and speaking order expeditiously strictly in accordance with law.

8. It is made clear that this Court has not expressed any opinion on the merits of the rival claims and all questions are left open to be decided by the competent authority.

9. With the aforesaid observations and directions, the instant writ petition stands disposed of.

10. There shall be no order as to costs.
