1. This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.192 of 2026 before the Matwada Police Station, Warangal, registered for the offences punishable under Sections 108, 75(2) and 78(2) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’).
2. The brief facts of the case are that on 21-04-2026, Sadu Sangeetha, a Civil Constable, was found hanging in her Warangal residence. Her father, reported the death, alleging that Sangeetha had suffered persistent physical harassment by Constable Sridhar. A suicide note recovered at the scene named Sridhar and an individual named Arundhati as responsible for her death due to continuous threats and harassment. Following the report, police registered a case against the accused for harassment and abetment of suicide.
3. Heard Mr. Mohd. Nawaz Hyder Ali, learned counsel for the petitioner and Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.
4. Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner and the deceased were working as constables in the same police station and were known to each other, and that the petitioner was transferred in September 2025. Since then, they had no contact with each other, and therefore the allegation that the petitioner is responsible for the suicide is without any basis. Hence, he prayed to grant pre-arrest bail to the petitioner by allowing the Criminal Petition.
5. Learned Assistant Public Prosecutor opposed the petition and submitted that the allegations against the petitioner are serious in nature, as they relate to harassment of a woman police constable, which allegedly led to her death. Further, the investigation was not yet completed. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition.
6. In the light of the submissions made by both the learned counsel and considering that serious allegations are levelled against the petitioner and the investigation is yet to be completed, this Court is of the considered view that it is not a fit case for grant of anticipatory bail to the petitioner at this stage.
7. Accordingly, the Criminal Petition is dismissed.
Miscellaneous applications, if any pending, shall stand closed.
