Heard learned counsel of both sides. It is submitted from the Bar that matter has already been settled in the mediation proceedings and therefore, in terms of the settlement arrived at by the parties, the present writ petition may be disposed of. The Court has perused the terms of the settlement as forwarded by the mediator and signed by the parties. The terms of the settlement are extracted hereunder:
“1. That is has been agreed between the parties that the petitioners, being survivors and successors of Late Khusi Pal, are entitled to the terminal benefits like leave salary, gratuity, GPF, etc., of Late Khusi Pal and Sri Sudipta Paul, the settling participant herein will have no objection if the said terminal benefits are disburse to the petitioners by the respondents.
2. That the settling participant, Sri Sudipta Paul, already received the benefit under the Tripura State Government Employees’ Group Insurance Scheme relating to Lt. Khusi Pal as her nominee, from the respondents. The petitioners confirm that they shall not claim any share in the said Group Insurance amount already received by Sri Sudipta Paul, i.e., the settling participant herein.
3. That as vide Registered Power of Attorney no.2023/UDP/IV/19999 dated 01.08.2023, the petitioner nos.1,3,4,5,6,7,8,9,10,11 appointed Shri Krishna Sukladas (petitioner no.2 in the Writ Petition) as their attorney to receive their shares in the terminal benefit of Late Khusi Pal, the respondents shall release the remaining admissible terminal benefit of Lt. Khusi Pal to the said attorney and tt shall be the responsibility of the said attorney Sri Krishna Sukladas to distribute the said among the petitioner nos. 1,3,4,5,6,7,8,9,10,11 as per their respective shares.
4. That the petitioners and Sri Sudipta Paul, the settling participant, jointly and severally agree to indemnify and keep indemnified the respondents from any future claim, dispute, demand or legal proceeding arising out of the aforesaid disbursement of terminal benefits of Lt. Khusi Pal.
5. All the parties have entered into the present agreement without any pressure, coercion, fear or undue influence from any side.
6. The parties and their heirs, successors shall remain bound by the terms of the present agreement, and all the parties herein shall co- operate for the performance of the same.”
The writ petition is disposed of with such terms and conditions of the settlement as arrived at between the parties. The report of the mediator containing such terms of settlement will form part of the order.
The writ petition stands disposed of.
Pending application(s), if any, shall also stand disposed of.
