(Prayer: This W.P is filed under Article 226 of the Constitution of India praying to direct of appropriate in Nature in quashing the endorsement dated 22.02.2026 in CPB/CTP-Sec/648/2026 as per Annexure-A as illegal, arbitrary and oppressive.)

Oral Order

1. Petitioner is before this Court seeks quashing of the impugned Endorsement at Annexure-A dated 22.02.2026 rejecting the request of the general parole application filed on behalf of the petitioner's brother - Sri.Ashoka Chakravarthy @ Ashoka s/o late B.Dasappa, who is currently serving sentence at the Central Prison, Bangalore, as a life convict - CTP No.15370 in terms of the Prison Manual and for other reliefs.

2. Heard learned counsel appearing for the petitioner and learned AGA appearing for respondents and perused the material on record.

The material on record discloses that the petitioner's brother has been convicted and sentenced to undergo imprisonment for life in relation to the proceedings in S.C.No.276/2015 vide judgment dated 15.05.2025 and the petitioner seeks parole on behalf of her brother on the humanitarian ground that their father late B.Dasappa expired on 04.05.2026 and it is necessary that the petitioner is granted parole for the purpose of attending and performing the last rites, obsequies, ceremonies, rituals etc., in this regard along with his family members and his request for parole having been rejected, petitioner is before this Court by way of the present petition.

4. I have given my anxious consideration to the rival contentions of both parties and perused the material on record.

5. The aforementioned facts are not in dispute and therefore, requires no reiteration. The petitioner seeks parole for her brother on ground that their father late B.Dasappa expired on 04.05.2026 and it is necessary that the petitioner is granted parole for the purpose of attending and performing the last rites, obsequies, ceremonies, rituals etc., in this regard along with his family members. Therefore, I deem it appropriate to quash the impugned Endorsement at Annexure-A dated 22.02.2026 and grant the petitioner's brother - Sri.Ashoka Chakravathy @ Ashoka s/o late B.Dasappa, a general parole for a period of six weeks, which becomes operational from 13.05.2026 to 24.06.2026.

6. In the result, I pass the following:-

ORDER

          (i) Petition is hereby allowed in part.

          (ii) Petitioner's brother, the detenue - Ashoka Chakravarthy @ Ashoka s/o late B.Dasappa (CTP No.15370) is granted a general parole for a period of six weeks which becomes operational from 13.05.2026 to 24.06.2026.

          (iii) The convict (CTP No.15370) - shall mark his attendance before the SHO of jurisdictional police station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional police to take him to jail, in the event, the convict (CTP No.15370) would evade going back to the jail after the expiry of the period of general parole.

          (iv) Respondent Nos.3 and 4 shall stipulate strict conditions as are usually stipulated, to ensure return of the detenue to the jail and that the convict shall not commit any other offences during the period of parole.

          (v) The learned AGA as well as the Registry are directed to communicate this order to respondent Nos.3 and 4, by way of telephone and e-mail forthwith.
