1. This complaint has been presented alleging deficiency in service with regard to the sale and delivery of a plot. The consideration whereof paid by the complainant to the opposite party - authority is Rs.1,85,88,644/-.

The office has raised an issue of pecuniary jurisdiction on the ground that the amount spent towards the registration or expenses for agreement to lease is stamp duty that is to be realised by the government towards the registration charges. Such expenses incurred are not the consideration paid to the opposite party and are rather statutory charges that are paid to the government exchequer.
3. The office has also therefore reported that in view of the law laid down by this Commission in the case of Pyaridevi Chabiraj Steels Pvt. Ltd. v. National Insurance Company Ltd., 2020 SCC OnLine NCDRC 845, as noted by the Supreme Court of India in the case of Rutu Mihir Panchal v. Union of India, 2025 SCC OnLine SC 974, has clearly defined as to what is paid consideration and therefore in view of the provisions of the Consumer Protection Act, 2019, the National Commission will not have the pecuniary jurisdiction, according to the calculation given by the complainant, where he has added an additional amount of Rs.10,45,000/- incurred for registration of the agreement to lease and Rs.5,00,000/- incurred as charges for registration.
4. Having examined the same we have dealt with this in detail in the order dated 20.03.2026 passed in NC/DN/9/2026, Nurture Work Space India LLP Vs. Bagga Luxury Motor Cars LLP (Petal Maserati), where we have decided this issue holding that the phrase "paid as consideration" would not include any amount which is paid to the state exchequer as taxes or statutory remuneration which in the present case is registration charges.
5. Accordingly, the objection raised by the office is upheld, the pecuniary jurisdiction limit threshold is not available to the complainant for filing the complaint before this Commission. The compilation is accordingly consigned without prejudice to the rights of the complainant to approach the appropriate forum for the redressal of her grievances.
