1. This is first application filed by the applicant under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023/ 439 of Cr.P.C. for grant of regular bail relating to FIR/Crime No. 350/2026 registered at Police Station - Industrial Area Ratlam, District Ratlam(M.P.) for offence punishable under Sections 108, and 3(5) of the BNS, 2023. She is in custody since 17.04.2026.
2. As per prosecution story, on 8.2.2026, Manish @ Dinesh committed suicide by hanging due to harassment of his wife and relatives.
3. Learned counsel for the applicant submits that the present applicant is wife of the deceased Manish who has committed suicide by hanging. He has submitted that a bare reading of FIR and material on record transpires that as investigation is still going on but it is at the verge of conclusion. He further submits that the allegations are made against brother of present applicant who happens to be brother-in-law of the deceased regarding some abusive language with the deceased before her death. He has submitted that the only allegation against the applicant is that she left her matrimonial house without informing her husband and therefore, the ingredients of Section 108 and Section 3(5) of BNS are not prima facie satisfied against the applicant and that the applicant is aged 34 years and having two daughters aged 3 years and 8 years respectively, therefore, her case may be considered for grant of bail by imposing some appropriate conditions.
4. Learned counsel for the State has opposed the prayer made by the applicant by submitting that the investigation is going on and charge sheet is yet not filed and considering the nature of allegations against both the accused persons no relief can be granted at this stage.
5. Heard the submissions and perused the case diary.
6. The offence registered under Sections 108 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 is reproduced as under:-
108. Abetment of suicide .--If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
3(5) When a criminal act is done by several persons in furtherance of the common intention of all, each of such persons is liable for that act in the same manner as if it were done by him alone.
The allegation made in the FIR, Prima facie is under Section 45 of the BNS. Considering the allegations in the FIR and the material which is produced before this court indicate that the allegations are mainly against Nitin, brother-in-law of deceased Manish who has committed suicide and now from bare reading of FIR and other material against the applicant it is clear that the applicant left her matrimonial home without informing her husband and before commission of suicide her brother Nitin has a quarrel by using abusive language with the deceased and therefore, prima facie considering the fact that applicant is having two daughters aged 3 years and 8 years and considering that now the investigation is at the verge of conclusion and considering the principle 'bail is the rule, jail is the exception' as well as Article 21 of the Constitution of India, and the fact that trial would take consideration time, without expressing any view on the merits of the case, I deem it a fit case to release the applicant on bail.

It is directed that the applicant shall be released on bail on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with separate surety in the like amount to the satisfaction of the trial Court concerned for her appearance before the said Court on all such dates as may be fixed in this regard during the pendency of trial.
8. The applicant shall comply with the provisions of Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita, 2023. She will not involve herself in any criminal activity otherwise it is open for the prosecution to move an application for cancellation of bail. This order shall be effective till the end of the trial. However, in case of bail jump and breach of any of the conditions of bail, it shall become ineffective.
