(Prayer: This W.P. is filed under Article 226 of the Constitution of India praying to quash the government order dated 07.09.2017 No. NAE 33 MNG 2017 passed by the Respondent No. 2 (Annexure-B) in the interest of justice and equity and etc.,)

Oral Order

1. In this petition, petitioners seek the following reliefs:

          "a) Issue a Writ of Certiorari to quash the Government Order dated: 07.09.2017 No. NAE 33 MNG 2017 passed by the Respondent No. 2 (ANNEXURE-B) in the interest of justice and equity.

          b) Issue a Writ of Mandamus directing the Corporation to regularize the services of the Petitioners on completion of 10 years of service in view of the order dated 06.04.2026 passed in WP No. 8346/2018 in Raghavendra Case (ANNEXURE-D)

          c) Issue a Writ of Mandamus directing the Respondents to pay equal pay for equal work as per the decision of the Hon'ble Court Apex Court in AIR 2016 SC 5176 in term of Article 39D of the Constitution of India;

          d) Issue a Writ of Mandamus directing the Respondents not to discriminate in the matter of absorption and payment of salary as it violates Article 14, 16, and 21 of Constitution of India;

          e) Issue a Writ of Mandamus to the Respondent No.3 and the Government (R 1 & 2) to consider the cases of the Petitioners on completion of 10 years of service in extending the security of tenure and further the case of the Petitioners should also be considered on completion of 3 years from quasi-permanent to permanent posts in terms of the Rule 40-A and 40-B KCSR Rules and also in terms of 5 of the Karnataka Temporary Service Rules of 1967 as amended, and

          f) Issue any appropriate a writ or order as deemed fit by this Hon'ble Court in the facts and circumstances of the case."

2. Heard learned Senior Counsel for the petitioners, learned AGA for respondent Nos.1 and 2 and learned counsel for respondent Nos.3 to 10 and perused the material on record.

In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned Senior Counsel for the petitioners submits that the petitioners, who have put in more than 13 years are entitled to regularization. It is also submitted that since the services of identically/similarly situated persons have already been regularised by the respondents, the petitioners are entitled to invoke the doctrine of parity and entitled for regularisation on this ground also.

Per contra, learned AGA submits that since the petitioners have not submitted any representation ventilating their grievances prior to filing of the present petition, the present petition may be treated as a representation and the respondents would consider the same and pass appropriate order/take appropriate decision in accordance with law in the light of the following judgments:

6. By way of reply, learned Senior Counsel for the petitioners submits that liberty may be reserved in favour of the petitioners to submit additional representation, which may be directed to be considered by the respondents within a stipulated time frame.

7. In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition by issuing certain directions. In the result, I pass the following:

ORDER

          i) The petition is hereby disposed of by treating the present petition as a representation submitted by the petitioners, ventilating their grievances for regularization to the respondent.

          ii) Liberty is reserved in favour of the petitioners to submit additional representation within a period of four weeks from today.

          iii) The concerned respondents shall address the grievances of the concerned petitioners and consider and take appropriate decision/pass appropriate orders on the representations for regularisation submitted by the petitioners in relation to the concerned respondents bearing in mind the judgments of the Hon'ble Apex Court and this Court referred to above and in accordance with law within a period of two months from the date of receipt of a copy of this order.
