(Prayer: This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, seeking certain reliefs.)
Oral Order
Sri.Basavaraj Mathapathi., counsel for the petitioners and Smt. Nandini B.Somapur., AGA for respondents 1 to 3 have appeared in person.
2. The Writ petition is filed seeking the following reliefs.
i. ISSUE A WRIT OF MANDAMUS or any other appropriate writ, order, or direction, directing the Respondent No. 3 (Special Land Acquisition Officer, Hidkal Dam) to consider and dispose of the Representations dated 23.06.2023 at vide to 25 in accordance with the law.
ii. DIRECT the Respondents to conduct a verification of the trees based on the Joint Measurement Certificate (JPC) No. LAQ-SR-3: 99 and the entries in the Record of Rights (RTCs) pertaining to the respective survey numbers of the petitioners, and thereafter pass a Supplementary Award for the payment of compensation for fruit-bearing and timber trees (as per the table provided in para no.3 of the petition);
iii. DIRECT the Respondents to calculate and disburse the compensation amount along with all statutory benefits, including solatium and NC: 2026:KHC-D:5570 HC-KAR additional market value at 12% p.a., within a stipulated time frame of six weeks.
iv. GRANT such other and further reliefs as this Hon'ble Court deems fit and proper in the interest of justice and equity."
3. Counsel for the petitioners submits that the petitioners are not pressing prayer Nos.2 and 3 as of today.
4. The submission regarding the non-pressing of prayer Nos.2 and 3 is taken on record.
5. As far as prayer No.1 is concerned, the petitioners contend that they have submitted representation dated 23.06.2023 vide Annexure-F. Their grievance is that the same has not been considered as of today.
6. Taking note of the grievance of the petitioners insofar as prayer No.1 is concerned, mandamus is ordered directing respondent No.3 to consider the representation submitted by the petitioners on 23.06.2023, within four weeks from the receipt of a certified copy of this order, in accordance with law, if the same has not been considered as of today.
7. The petitioners are also at a liberty to file one more detailed representation highlighting the number of trees and to put forth their grievance. At the time of consideration of the representations, an opportunity may also be afforded to respondent No.4 to put forth his grievance.
8. With the above observation, writ petition is disposed of. Needless to observe that this Court has not expressed any opinion on the merits of the case.
